This paper addresses the problem of articulating ethics with justice, as it would seem impossible to think the practical application of one without denying the other at the same time. Indeed, as Levinas puts it, justice is violence within ethics when trying to compare the incomparable. On the contrary, ethics is an asymmetrical and irreversible relationship between two, where justice seems to have no room at all. This work seek to provide an articulation between both immeasurable dimensions by a renewed (...) attention to the issue of temporality of ethics and by including the concept of impure, taken from the work of Jean Guitton, from which it is understood that both dimensions are co-implicated from the very difference that constitute them. In this article I try to prove that the crisis of the West is necessarily linked to the crisis of a monotheism, which has lost its primordial sense. Indeed, because God was conceived of in Western civilization on the basis of the Plotinian unus—that is, on the basis of identity—and every other relationship to alterity was conceived of following this very same criterion, sociality was defined as plurality of the individual, as a mere numerical multiplicity. Against this conception I sketch (...) a new schema for thinking of God and thinking of the relation to otherness based on a differentiality irreducible to any identity. I depict this differentiality as based on the Husserlian conception of time consciousness, defining it not only as a mere lack of identity but as a non-indifference for the other. Hence, I conclude that it is possible to think of a true monotheism that fosters a multiplicity of religions that are not indifferent but responsible to each other. (shrink)

En el presente artículo se intenta poner de relieve cómo la comp- rensión levinasiana del tiempo contribuye a la recuperación del valor y del sentido del instante presente, el cual ha sido menospreciado hasta nuestros días en gran parte de la tradición filosófica en tanto concebido a partir del tiempo, pensado este último como duración. Se trata así pues de pensar el sentido propio del instante en sí mismo, en cuanto momento presente, independientemente del sentido fun- cional que se le (...) asigna como parte de un conjunto –la duración– que lo abarca y en el que se absorbe. Se tratará por lo tanto de imaginar otras metáforas para explicar el acaecer temporal, distintas de la del punto, de la línea o de la del flujo del devenir; metáforas a partir de las cuales el tiempo ha sido siempre comprendido como un continuo homogéneo. In the present paper it is shown, following Levinas, that Ethics, understood as an intersubjective relation among completely separate subjects, sets itself up starting from concrete events that determine man's historical existence, but these are invested with the peculiarity of being events which escape the ontological order. Rather, they send to somewhere beyond, outside ontology, signifying above all in an ethical fashion, i.e., in a way other than being.

En el presente artículo se arriesga una nueva interpretación del concepto kantiano de autonomía, abordándolo desde una perspectiva “heterónoma”. En efecto, sin soslayar la interpretación ya clásica de aquél se indaga sobre la posibilidad de pensarlo como tributario de una heteronomía que señala de alguna manera a la autonomía una dignidad sobre la cual ésta no puede tener prácticamente ninguna injerencia. Resumen El artículo expone la noción de temporalidad discontinua implícita formalmente en la fenomenología de la conciencia interna del tiempo de Husserl y las correspondencias equivalentes que se encuentran en una lectura atenta de la obra de Marcel Proust. Para eso se reconstruye la peculiar noción de tiempo implícita en la obra de ambos autores mostrando el sentido diferencial y discontinuo que la misma reviste. A partir de dicha reconstrucción se desarrollan las implicaciones críticas que la misma acarrea respecto de (...) las concepciones tradicionales de memoria, subjetividad y corporalidad. Finalmente se hacen algunas consideraciones respecto de las influencias recíprocas entre filosofía y arte.The article exposes the notion of a discontinuous temporality formally implied in Husserl's phenomenology of internal time consciousness and its corresponding equivalencies found in an attentive reading of the work of Marcel Proust. To this end, the peculiar notion of time implicit in the work of both authors is reconstructed showing the differential and discontinuous sense that this notion has. It is developed the critical implications that this reconstruction carries with it regarding the traditional conceptions of memory, subjectivity and corporeality. Esta investigación ofrece un esbozo de una forma alternativa de concebir la categoría clásica de la subjetividad que subyace al concepto de objeción de conciencia y de desobediencia civil. La mayoría de los puntos de vista habituales sobre este tema se centran en el individuo y sus derechos. Demostrando que este enfoque es insuficiente y, por lo tanto, insatisfactorio, esta investigación destaca la importancia de conceptualizar de nuevo la categoría de subjetividad, lo que a su vez hará posible una nueva (...) forma de conceptualizar la noción de objeción de conciencia, es decir, pensar en ella no más como un derecho individual, sino como un deber de responsabilidad social. Wie ist die erhoffte Gerechtigkeit des Einen mit dem konkret werdenden Ethischen durch die Handlung des Anderen zum Zeitpunkt des Geschehens verstrickt? Diese »Verstrickung« wird als eine Komplikation verstanden, welche die beruhigte Einsamkeit des modernen Subjekts stört. Dieses störende Ereignis der Verantwortung lässt sich nicht als Ergebnis eines Kalküls zwischen Verbotenem und Erlaubtem (...) begreifen. Denn die wirkliche Gerechtigkeit geschieht nur in der konkreten geschichtlichen Handlung, die die theoretischen Widersprüche, die sich in einem zeitlos-idealistischen Denken zu geben scheinen, übersteigt. The aim of this study consists of postulating an ethical approach to Human Rights conceiving them as rights of the other, claiming that this approach represent a starting point for the development of a legal pluralism that contributes to the achievement of an effective and authentic peace. For this study is based on the premise that the law must be able to deal with the serious and still pending social and environmental problems that underlie the violations of human rights, especially (...) those of ecological nature. By way of conclusion, the need for a radical change of the paradigm is evidenced, for which a perspective of ethics as a linguistic praxis is proposed, since such praxis has the potential to inspire the reformulation of human rights, for the purpose of reversing the dynamics of violence imposed by the logic of identity underlying the current legal system. In this work we discuss logical structures related to indistinguishable particles. Most of the framework used to develop these structures was presented in [17, 28] and in [20, 14, 15, 16]. We use these structures and constructions to discuss possible ontologies for identical particles. In other words, we use these structures in order to characterize the logical structure of quantum systems for the case of indistinguishable particles, and draw possible philosophical implications. We also review some proposals available in the literature (...) which may be considered within the framework of the quantum logical tradition regarding the problem of indistinguishability. Besides these discussions and constructions, we advance novel technical results, namely, a lattice theoretical structure for identical particles for the finite dimensional case. This kind of approach was not present in the scarcely literature of quantum logic and indistinguishable particles. (shrink)

El propósito de este trabajo es explicitar los requisitos que debe cumplir una buena teoría acerca de lo emocional, a partir del examen crítico de tres enfoques distintos: el conductismo, el funcionalismo y el enactivismo. The extent to which people anticipate and are influenced by the potential future consequences of their current behavior is called Consideration of Future Consequences. A well-established tool to measure this construct is the 14-item Consideration of Future Consequences Scale. The CFC-14 has shown appropriate psychometric properties in several languages. This scale comprises two factors: the CFC-Immediate and the CFC-Future. The main goal of this study was to assess the psychometric properties and internal consistency of the CFC-14 Scale in Spanish, using (...) an Argentine sample. A secondary goal was to determine its convergent validity with impulsivity, and determine differences across gender and age groups. Using a web-based survey, we collected data from 512 participants aged 13-74 years. Confirmatory Factor Analysis showed a 2-factor model as the best solution for 13-items version. Standardized regression weights ranged from.50 to.66 for CFC-F and between.43 and.83 for CFC-I. Composite reliability was also adequate: CFC-F achieve? =.80 and CFC-I? =.82. There were no differences across gender and age. The CFC-F subscale and UPPS-P subscales correlations, were negative and significant, highlighting the negative and moderate correlation between CFC-F and the lack of premeditation, a dimension strictly related to intertemporal decisions making. Thus, CFC-14 has adequate psychometric properties in an Argentinian population, although more studies are necessary to determine the robustness of these findings. (shrink)

Dicha propuesta incluye recomendaciones sobre las normas procedimentales y normas sustantivas que deben regir la asignación y reasignación de recursos terapéuticos en condiciones de escasez extrema.

El texto es una contrarréplica a las críticasdel profesor Pablo Arango. Se argumenta, principalmente, que a pesar de las observaciones de Arango en sentido contrario, el esencialismo no puede hacer frente a una versión interesante de la relatividad conceptual, que el argumento que va desde la designación rígida hasta el esencialismo no es concluyente, y que la metafísica esencialista viola el principio de sustituibilidad de los términos correferenciales.

Can addiction be credibly invoked as an excuse for moral harms secondary to particular decisions to use drugs? This question raises two distinct sets of issues. First, there is the question of whether addiction is the sort of consideration that could, given suitable assumptions about the details of the case, excuse or mitigate moral blameworthiness. Most discussions of addiction and moral responsibility have focused on this question, and many have argued that addiction excuses. Here I articulate what I take to (...) be the best argument for this view, based on the substantial difficulty that people with severe addiction experience in controlling drug-related behavior. This, I argue, may in some cases be sufficient to ground a mitigating excuse, given the way in which addiction undermines agents’ responsiveness to relevant moral reasons to do otherwise. Much less attention has been devoted to a second set of issues that critically affect the possibility of applying this mitigating excuse in particular cases, derived from the ambivalent nature of agential control in addiction. In order to find a fitting response to moral harm, the person with the right standing to blame must make a judgment about the extent to which the agent possessed certain morally relevant capacities at the time of the act. In practice, this will often prove tremendously difficult to assess. The ethical challenge for the person with the right standing to blame is fundamentally one of making a judgment about matters that seem underdetermined by the available evidence. (shrink)

Emoticons and facial emojis are ubiquitous in contemporary digital communication, where it has been proposed that they make up for the lack of social information from real faces. In this paper, I construe them as cultural artifacts that exploit the neurocognitive mechanisms for face perception. Building on a step-by-step comparison of psychological evidence on the perception of faces vis-à-vis the perception of emoticons/emojis, I assess to what extent they do effectively vicariate real faces with respect to the following four domains: (...) Investigating the theoretical and empirical relationships between transparency and trust in the context of surveillance, this volume argues that neither transparency nor trust provides a simple and self-evident path for mitigating the negative political and social consequences of state surveillance practices. Dominant in both the scholarly literature and public debate is the conviction that transparency can promote better-informed decisions, greater oversight, and restore trust damaged by the secrecy of surveillance. The contributions to this volume challenge this conventional wisdom by considering (...) how relations of trust and policies of transparency are modulated by underlying power asymmetries, socio-historical legacies, economic structures, and institutional constraints. They study trust and transparency as embedded in specific socio-political contexts to show how, under certain conditions, transparency can become a tool of social control that erodes trust, while mistrust-rather than trust-can sometimes offer the most promising approach to safeguarding rights and freedom in an age of surveillance. Munch-Jurisic’s book thoroughly describes several cases of severe distresses reported and expressed by perpetrators of tremendous acts such as mass murders. Arguing against a simplistic reading according to which these signs of distress are straightforward manifestations of some innate moral nature, and against the optimistic reading according to which they will lead to prosocial behaviors, Munch-Jursic offers compelling reasons to adopt a more complex theory of emotion. In this commentary, I aim to stress the implications of her book for the (...) debate on moral enhancement and for emotion theory in general. However, while I concur with Munch-Jurisic that emotion theory must make room for complexity and indeterminacy, I challenge her claim that motivational theories of emotion are ill-equipped to face the challenges she poses. It is often assumed that, except perhaps in a few rare cases, people with addiction can be aptly held responsible for having acquired the condition. In this chapter, I consider the argument that supports this view and draw attention to a number of challenges that can be raised against it. Assuming that early decisions to use drugs were made in possession of normal-range psychological capacities, I consider the key question of whether drug users who later became addicted should have known (...) that addiction was a likely outcome of their decisions to use drugs in a way that makes them blameworthy for their lack of foresight. I focus on three different points of contention surrounding this claim: how likely the outcome to be predicted was, how tolerable risk should be weighed against the expected value of decisions to use, and how reliable the relevant predictive abilities of the average person are. Once we consider in some detail what would have to be true in order for someone to be aptly held responsible for becoming addicted, the prospects for making a convincing case to that effect look, I argue, somewhat more uncertain than they might at first appear. In this paper I argue that Fricker’s influential account of testimonial injustice (hereafter ‘TI’) should be expanded to include cases of TI from mutually neutralising countervailing prejudices. In this kind of case, the hearer is given due credibility by the speaker. I describe a relevant case, defend it from objections, highlight how it differs from extant cases of due-credibility TI and describe its distinctive features. This case demonstrates how paying attention to the way multiple prejudices operate in concert leads to (...) expanding the repertoire of cases of TI and casts light on the harms of TI. (shrink)

De un lado, tenemos la “perspectiva de la tercera persona”. Desde esta mirada, cada acto que realizamos está causalmente determinada. Por el otro lado, tenemos la “perspectiva de la tercera persona”, en la que todas nuestras acciones libres parecieran brotar del “yo”. While some form of loss of control is often assumed to be a common feature of the diverse manifestations of addiction, it is far from clear how loss of control should be understood. In this paper, I put forward a concept of decrease in control in addiction that aims to fill this gap and thus provide a general framework for thinking about addictive behavior. The development of this account involves two main steps. First, I present a view of degrees of (...) control as the degree to which an agent would be responsive to potential or counterfactual sufficient reasons to do otherwise. Second, I sketch an account of the relevant control-undermining factors in addiction that is consonant with my proposed view of degrees of control. Being a high-level functional property, reasons-responsiveness is particularly well suited to frame an account of control-undermining factors that is doubly pluralistic: it encompasses the contribution of factors both internal and external to the agent, and it is consistent with various proposals as to the precise nature of the anomaly taking place in the psychology of addiction. Advancements and deployments of AI-based systems, especially Deep Learning-driven generative language models, have accomplished impressive results over the past few years. Nevertheless, these remarkable achievements are intertwined with a related fear that such technologies might lead to a general relinquishing of our lives’s control to AIs. This concern, which also motivates the increasing interest in the eXplainable Artificial Intelligence (XAI) research field, is mostly caused by the opacity of the output of deep learning systems and the way that it is (...) generated, which is largely obscure to laypeople. A dialectical interaction with such systems may enhance the users’ understanding and build a more robust trust towards AI. Commonly employed as specific formalisms for modelling intra-agent communications, dialogue games prove to be useful tools to rely upon when dealing with user’s explanation needs. The literature already offers some dialectical protocols that expressly handle explanations and their delivery. This paper fully formalises the novel Explanation–Question–Response (EQR) dialogue and its properties, whose main purpose is to provide satisfactory information (i.e., justified according to argumentative semantics) whilst ensuring a simplified protocol, in comparison with other existing approaches, for humans and artificial agents. The deep influence of affectivity on learning is now widely acknowledged (Keefer et al., 2018; Sánchez-Álvarez et al., 2021). For instance, it has been shown that affect influences key learning-relevant processes, such as motivation, perception, behavior, and critical thinking (Izard, 2002; Mayer & Salovey, 1997). Evidence also shows that emotion and mood strongly influence attention, which in turn drives learning and memory (Elbertson et al., 2010; Elias et al., 1997). Intersubjective phenomena, such as the degree of affection and respect between (...) child and teacher, also affect the child’s learning processes, academic outcomes, and brain development (Kusché & Greenberg, 2006; Ryan & Patrick, 2001). However, the relevant literature is not paying attention to increasing evidence showing that affective phenomena are rooted in interoceptive and homeostatic self- and co-regulatory processes within and between people’s living bodies (Barrett, 2017; Carvalho & Damasio, 2021; Craig, 2015, 2018; Fotopoulou et al., 2022; Fotopoulou & Tsakiris, 2017; Seth & Friston, 2016). In this theoretical chapter, we explore this connection and its importance for learning. We argue that affective experience plays a fundamental role in learning, and that affective experience is rooted in the homeostatic self-/co-regulation of living bodies. Therefore, the homeostatic self-/co-regulation of living bodies plays a fundamental role in learning. In other words, there is an intra- and interpersonal somatic dimension of learning that demands explicit consideration in educational contexts. In this way, we aim to contribute to an understanding of learning and education that moves away from an individualistic, brain-centered information-processing conception toward one centered on sentient, interdependent living bodies. A comparison between the Prolegomena of Chapter II of De iure praedae and the Prolegomena of De iure belli ac pacis leads to the conclusion that the ideas of Grotius on legal systematization have changed considerably between 1604 and 1625. Whereas Grotius starts in IPC with general principles with a rather unclear distinction between leges and regulae, in IBP he gives first the philosophical and theological basis of international law, intertwined by a concise set of general legal rules, mostly derived (...) from Roman law after its reception in Western Europe. The general outlines of legal systematization in the early-modern period are expounded. In the attempts of legal systematization the concept of subjective rights is essential. These subjective rights are not, as is sometimes assumed, a medieval renewal of legal technique, but can be found essentially already in classical Roman law of the first centuries AD.The institutional system is not yet visible in De iure praedae, it might be different for De iure belli ac pacis. Significant here are possibly the expressions ius ad bellum and ius in bello. (shrink)
