Um das achtzehnte Jahrhundert herum zogen verschiedene Denker dem Staat eine auch heute noch vielbeachtete Grenze: Religion ist Privatsache. Fragen der Religion lägen jenseits dessen, wo der Staat legitimerweise wirken könne. Diese Forderung nach einer Trennung von Staat und Religion wird heute wesentlich als eine Frage der Gewissensfreiheit gedeutet. Wo wir Gewissensfreiheit missachten, erlegen wir Individuen unzumutbare Gewissensnöte auf Der Laizismus bewahrt damit die Unverletzlichkeit religiöser Einstellungen. Gewissensfragen gibt es jedoch nicht nur in der Religion. Es gibt sie auch in (...) der Moral, und sogar in individuellen Lebensperspektiven und Weltanschauungen jenseits von Religion und Moral. Wer Denkern wie Jefferson und Humboldt folgen will, muss daher weiter gehen. Der Aufsatz entwickelt die Konsequenzen für einen in Hobbes und Locke gründenden Kontraktualismus. Ich deute Gewissensgründe als politischen Zustimmungsvorbehalt, der dem kontraktualistischen Gemeinwesen strikte Neutralität abverlangt. Gewissensfreiheit zu missachten zerstört daher das politische, das „Locke'sche" Vertrauen, welches das Gemeinwesen trägt. *—————* Around the eighteenth century, several theorists came to advocate the separation of religion and state. In various ways they argued that all that concerns religion lies beyond the sphere of the state's activity. This "wall of separation" is today often understood as a matter offreedom of conscience. Wherefreedom of conscience is infringed, man 's soul is burdened beyond what the individual can bear. The separation of religion and state thus protects the inviolability of religious attitudes. However, matters of conscience are not exclusively religious. They can be moral, or even pertaining to individual worldviews beyond morality or religion. Those who want to follow thinkers like Jefferson or Humboldt must therefore go beyond their call. This paper investigates the consequences for contractarianism in the spirit of Hobbes and Locke. I suggest conscientious reservations are implied conditions for contractarian consent which oblige the commonwealth to strict neutrality in matters offreedom of conscience. To infringe uponfreedom of conscience thus destroys the band ofthe commonwealth, i.e., political, "Lockean" trust. -/- . (shrink)

Trois auteurs dramatiques, Arthur Schnitzler (1862-1931) dans Au Grand Guignol, Paul Claudel (1868-1955) dans Le Soulier de Satin, et Marguerite Duras (1914-1996) dans Savannah Bay, nous placent au cœur même du processus de la représentation théâtrale, fait d’imprévus, d’incertitudes et d’accidents. Cette écriture rend sensible un temps dynamique, vivant et jaillissant, qui n’est pas sans rappeler la conception bergsonienne du temps comme « création continue d’imprévisible nouveauté ». In recent years a growing number of scholars in science studies and related fields are developing new ontologies to displace entrenched dualisms. These efforts often go together with a renewed interest in the roles played by symbolisms and tools in knowledge and being. This article brings Maurice Merleau-Ponty into these conversations, positioning him as a precursor of today’s innovative recastings of technoscience. While Merleau-Ponty is often invoked in relation to his early work on the body and embodiment, this article focuses (...) on his later work, where the investigation of perception is integrated with an ontological exploration. The resulting approach revolves around the highly original idea of the body as a standard of measurement. We further develop this idea by coining the term ‘the measuring body’, which to a greater extent than did Merleau-Ponty accentuates the relative autonomy of symbolisms and tools and their capacity to decentre the perceiving body. Pliny's Natural History is often referred to as one of the first western encyclopedias and its encyclopedism is central to how it is used and understood. This article argues for a reassessment of the grounds on which we call the Natural History an encyclopedia by reexamining its relationship to the works of Cato, Varro, and Celsus and to the ancient educational concept of enkuklios paideia. If Pliny's Natural History is an encyclopedia, it is not because it belonged to an ancient (...) genre of encyclopedias that ancient readers and writers recognized as such; its encyclopedism needs to be understood instead as a product of the text's reception history. Metaphysics is not often spoken of as a venue for dialogue about anything, let alone culture or religion, which are more readily associated with phenomenology or hermeneutics in contemporary thinking. This collection of essays, however, by the late Boston College philosopher Oliva Blanchette, maintains the absolute necessity of metaphysics as a prerequisite for examining any particular 'realm of being,' in all areas of human inquiry, from the particular sciences to historical cultures and religions. Blanchette proposes metaphysics as a fundamental (...) and necessary level of intelligence presupposed in any exercise of judgment, discourse, or dialogue, among rational beings. At the same time, he defends the idea that dialogue is the first and most fundamental form in which such reasoning takes place in human experience, on a radically intersubjective level through language. No doubt all are familiar with the story of Abraham, of whom God demanded the sacrifice of his son, Isaac, and who, at the last minute, received from this same God the order not to touch the child since it was by then certain that Abraham would not refuse to do so. Ultimately, as the Bible itself seems to say, was this not simply a test in those remote times when, after all, sacrifice was a common occurrence? And so, perhaps, (...) we might think this is all there is to this story, simply a matter of fear. Nevertheless, how can we not be amazed by the seeming gratuity of such an ordeal? Was not Abraham, and already since a very long time, the chosen one of God? Can we not, then, ask if a more attentive reading of the texts will provide a more substantial message? (shrink)

La recherche sociologique réalisée auprès de 23 jeunes résidents de villages d’accueil de l’association SOS Villages d’Enfants, qui a pour vocation l’accueil d’enfants placés en fratries, a été un cadre spécifique pour examiner la diversité des expériences, de liens et de sentiments fraternels. Au-delà d’un état de la question du fraternel, une réflexion a pu être menée sur les attentes et l’idéalisation à l’égard de leurs germains, de leurs demis et/ou des enfants avec qui ils vivent au quotidien. C’est aussi (...) dans ce vivier de pairs familiers, ce potentiel de lien social, que les jeunes acteurs choisissent certains individus pour affirmer des liens privilégiés. La cohabitation est le creuset de proximités affinitaires permettant le maintien des liens de germanité et l’avènement de liens fraternels. (shrink)

This article contributes to contemporary philosophy of technology by carrying out a diffractive reading of Ernst Cassirer’s “Form und Technik” (1930) and Gilbert Simondon’s Du mode d’existence des objets techniques (1958). Both thinkers, who are here brought together for the first time, stood on the brink of the defining bifurcations of twentieth-century philosophy. However, in their endeavor to come to grips with the “being” of technology, Cassirer and Simondon, each in their own way, were prompted to develop an ontology of (...) emergence that gives ontological priority to “technicity,” that is, to technology considered in its efficacy or operative functioning. By reading Cassirer’s and Simondon’s insights through one another, we aim to further develop this ontology of emergence, and, simultaneously, to demonstrate the relevance of these thinkers for present-day theorizing. As we hope to show, the insistence on the ontological force of technological apparatuses transverses received philosophical and ontological divides and revitalizes the notions of “nature” and “the human,” which are now understood as coevolving with technology. Cassirer's approach to symbolic mediation differs in some important ways from currently prevailing approaches to meaning and signification such as semiology and its more recent poststructuralist varieties. Cassirer's philosophy of symbolic forms offers a theory of symbols that does not amount to a sign theory or semiology. It sketches out, rather, a dynamic and nonrepresentational framework in which an alternative notion of difference takes centre stage. In order to make the original features of Cassirer's approach stand out, I will compare (...) it with the approach of the perhaps most influential differential thinker of our day, Jacques Derrida. The philosophy of symbolic forms explicitly prefigures a great many of the insights and concerns of poststructuralism. Yet, there are some critical differences. Rather than rejecting the concepts of objectivity, identity, and truth on the premises established by traditional metaphysics, Cassirer chooses to redefine these concepts through a radical conceptual reframing. The result is a doctrine that—in Derridean parlance—neither jumps beyond the oppositions of metaphysics, nor tries to resolve them in a Hegelian synthesis—a doctrine, that is, that even though it appeals to origins, cannot so easily be dismissed as yet another instantiation of the metaphysics of presence. Après s'être intéressée aux rapports de la linguistique avec la société en 2003. avec les sciences de l'homme en 2005, avec les demandes sociales en 2007, avec les nouvelles technologies en 2009, l'Association des Sciences du Langage a souhaité. pour l'édition 2011 de son colloque biennal, élargir géographiquement la réflexion en invitant des chercheurs d'autres pays d'Europe. Ce recueil rend ainsi compte. en douze articles et en langue française, de travaux portant sur le français, l'allemand, le grec, le tchèque. le (...) roumain et le finnois. centrés sur la grammaire, l'analyse de discours, les rapports entre langue et culture et le multilinguisme. L'ouvrage permet au lecteur de prendre connaissance de ce qui se fait ailleurs en matière de recherche et d'enseignement universitaires dans le domaine des sciences du langage, en relation ou non avec ce qui se fait en France. L’invention du microscope donna une visibilité inédite aux insectes surtout à partir du dernier tiers du xvii e siècle. Mais ces découvertes récentes ne firent que conforter un mouvement plus vaste d’écriture et de poétisation du micro-monde amorcé dès la Renaissance. Certes, les insectes demeurent encore subordonnés à l’éloge de la femme aimée ou à la satire sociale comme à l’apologie de la religion chrétienne ou du matérialisme. A l'heure de l'inflation normative, une réflexion sur la fin du droit peut paraître paradoxale, voire aller à contre-courant des mutations contemporaines du droit. En outre, les nombreux travaux relatifs à ces mêmes mutations et aux transformations du droit ces dernières années laissent penser que le droit ne peut connaître de fin, se renouvelant en permanence pour ne jamais laisser d'espace de non droit. Sans à coup, sans coupe nette, le droit poursuivrait sa progression sans heurt. Le droit n'aurait-il donc (...) jamais de fin? L'adage "ubi societas ibi jus" plaide, à l'évidence, pour une réponse négative. Cependant, de multiples questions se posent. Est-ce qu'une norme peut vraiment cesser d'exister et si oui, à partir de quand? Le droit connaît-il un terme? Peut-il disparaître? Cassirer's thought-provoking essay Form and Technology (1930) considers the theoretical work performed by material instruments and, in so doing, it ascribes to technology a new dignity as a genuine tool of the mind in equal company with language and art. Germinating in this essay, we find an ambitious program for a new kind of philosophy of technology that resonates with contemporary approaches focusing on material apparatuses, relational and performative processes, and the embodied, embedded, and enacted nature of perception and cognition. Cassirer's approach, however, is unique in the way that it integrates logical concerns, championed by scientifically oriented philosophers, with the concerns of the historical and cultural sciences. The current revival of interest in Cassirer's thinking has precisely to do with its potential for bridging unproductive intellectual gaps. Form and Technology, especially, provides a rich resource for current attempts, across disciplines, to develop new conceptual and ontological frameworks. This article presents a parametrized functional interpretation. Depending on the choice of two parameters one obtains well-known functional interpretations such as Gödel's Dialectica interpretation, Diller-Nahm's variant of the Dialectica interpretation, Kohlenbach's monotone interpretations, Kreisel's modified realizability, and Stein's family of functional interpretations. A functional interpretation consists of a formula interpretation and a soundness proof. I show that all these interpretations differ only on two design choices: first, on the number of counterexamples for A which became witnesses for ¬A when defining (...) the formula interpretation and, second, the inductive information about the witnesses of A which is considered in the proof of soundness. Sufficient conditions on the parameters are also given which ensure the soundness of the resulting functional interpretation. The relation between the parametrized interpretation and the recent bounded functional interpretation is also discussed. (shrink)

En tant que mineures juridiques, les femmes romaines sont normalement exclues des privilèges politiques tel que le droit de vote, tout comme elles sont exemptes des devoirs des citoyens (armée ou charges fiscales). Les femmes bénéficiaient cependant pleinement des privilèges garantis par le droit civil. Et bien que leur prise de parole dans des contextes politiques relève de l’exceptionnel, les lieux d’exercice de la citoyenneté leur étaient accessibles. C’est dans la religion publique que le terme civis Romana apparaît finalement. De (...) cette étude, il résulte que la citoyenne romaine existait bel et bien, et que cette citoyenneté se rapprochait de la civitas sine suffragio. La société romaine reposait avant tout sur des inégalités et une hiérarchie omniprésentes : entre les hommes citoyens de plein droit, entre eux et les citoyens sans suffrage, et entre citoyens et femmes citoyennes. Cependant, tous pouvaient expérimenter une forme de citoyenneté à travers des actes civiques. (shrink)

The aim of this study was to illuminate the meaning of receiving help from home nursing care for the chronically ill, elderly persons living in their homes. The study was carried out in Norway. Data were collected by narrative interviews and analysed by phenomenological hermeneutic interpretations. Receiving help from home nursing care sometimes meant ‘Being ill and dependent on help’. Other times it meant ‘Being at the mercy of help’. It could also mean ‘Feeling inferior as a human being’. Sometimes (...) help was given by nurses who were respectful and proficient at caring for an elderly person, while at other times nurses seemed to be incompetent and worked with a paternalistic attitude without respect for privacy. Receiving help also meant elderly persons wanted to be regarded and approached as equal human beings, supported in the courage to meet challenges in life. (shrink)

Este artículo se adentra en los temas y tópicos vitales de la obra literaria de Eliacer Cansino, escritor dedicado a la literatura juvenil, e invita a reflexionar sobre cómo su lectura puede desarrollar el pensamiento crítico de los jóvenes lectores del siglo XXI. Para abordar esta investigación, se ha recurrido a una metodología de corte cualitativo, con especial atención a la narrativa biográfica. De esta manera, dado que literatura y realidad constituyen dos caras de una moneda al forjar lectores, se (...) analizó el perimundo literario de Eliacer Cansino. Los resultados justifican que la lectura de la obra de este autor es un referente literario para el desarrollo del pensamiento crítico desde la experiencia lectora de los adolescentes. (shrink)
