In November, 1991, the U.S. Congress enacted the U.S. Federal Sentencing Guidelines legislation which had a dramatic impact on corporate America. Can the Guidelines be used as a model or framework by other countries? Could other countries in the world benefit from adopting a similar piece of legislation? Are there any limitations to consider? We present an ideal profile of an emerging organizational function: the Ethics Officer. We argue that the main contribution of an EO is to provide management with a broad perspective of the organization's stakeholders – one that emphasizes the interests of all stakeholders, including those not affiliated with the dominant coalitions in the organization. In order to avoid turning the EO into a rubber stamp for management activities, we suggest that certain conditions prevail to enable the person in this position (...) to exercise impartial, independent judgment. These conditions are embodied in our profile, which maintains that an ideal EO should have appropriate organizational status, functional independence, professionalism, knowledge of organizational issues, and knowledge of ethics theory. This study examines the ethical beliefs and behavior of a sample of Israeli managers (n=97) and comparable data from the United States. Israeli managers rated themselves both highly ethical and more ethical than their peers. These results are similar to those found for the U.S., and indicate that the best predictor of respondents' ethical behavior is their beliefs and perceptions concerning their peers' behavior. In addition, this study examines the managers' predisposition to promote social responsibility by joining social networks of (...) managers and other business people, established for that purpose. The purpose of the present study was to identify the sources of social support for feminist issues in Israel. Attitudes toward these issues as social problems and toward feminism as a social movement were examined through a questionnaire administered to 2,097 university students studying in the Tel Aviv area in 1985-1986. The study found that Israeli students who considered gender discrimination in promotion and prohibitions against abortion severe social problems were more likely to be on the political left, nonreligious or (...) secular, and generally tolerant of difference and open to change. Support for the perception of violence against women as a social problem was stronger than for the other two issues and cut across the dominant cleavages in Israeli society. Students do not connect violence against women with gender inequality. These findings and their significance for the development of feminism in Israel are discussed within the framework of Gamson and Modigliani's analysis of the culture of policy issues. (shrink)

Recent evidence from cognitive neuroscience suggests that certain cognitive processes employ perceptual representations. Inspired by this evidence, a few researchers have proposed that cognition is inherently perceptual. They have developed an innovative theoretical approach that rests on the notion of perceptual simulation and marshaled several general arguments supporting the centrality of perceptual representations to concepts. In this article, I identify a number of weaknesses in these arguments and defend a multiple semantic code approach that posits both perceptual and non-perceptual representations.

The dominant, individualistic understanding of autonomy that features in clinical practice and research is underpinned by the idea that people are, in their ideal form, independent, self-interested and rational gain-maximising decision-makers. In recent decades, this paradigm has been challenged from various disciplinary and intellectual directions. Proponents of ‘relational autonomy’ in particular have argued that people’s identities, needs, interests – and indeed autonomy – are always also shaped by their relations to others. Yet, despite the pronounced and nuanced critique directed at (...) an individualistic understanding of autonomy, this critique has had very little effect on ethical and legal instruments in clinical practice and research so far. A great deal of research has focused on the question of whether or not concepts are embodied as a rule. Supporters of embodiment have pointed to studies that implicate affective and sensorimotor systems in cognitive tasks, while critics of embodiment have offered nonembodied explanations of these results and pointed to studies that implicate amodal systems. Abstract concepts have tended to be viewed as an important test case in this polemical debate. This essay argues that we need to move beyond a (...) pretheoretical notion of abstraction. Against the background of current research and theory, abstract concepts do not pose a single, unified problem for embodied cognition but, instead, three distinct problems: the problem of generalization, the problem of flexibility, and the problem of disembodiment. Consciousness and Physicalism: A Defense of a Research Program explores the nature of consciousness and its place in the world, offering a revisionist account of what it means to say that consciousness is nothing over and above the physical. By synthesizing work in the philosophy of mind, metaphysics, and philosophy of science from the last twenty years and forging a dialogue with contemporary research in the empirical sciences of the mind, Andreas Elpidorou and Guy Dove advance and defend a (...) novel formulation of physicalism. Although physicalism has been traditionally understood to be a metaphysical thesis, Elpidorou and Dove argue that there is an alternative and indeed preferable understanding of physicalism that both renders physicalism a scientifically informed explanatory project and allows us to make important progress in addressing the ontological problem of consciousness. A growing body of evidence suggests that cognition is embodied and grounded. Abstract concepts, though, remain a significant theoretical chal- lenge. A number of researchers have proposed that language makes an important contribution to our capacity to acquire and employ concepts, particularly abstract ones. In this essay, I critically examine this suggestion and ultimately defend a version of it. I argue that a successful account of how language augments cognition should emphasize its symbolic properties and incorporate a view of embodiment (...) that recognizes the flexible, multi- modal and task-related nature of action, emotion and perception systems. Our thoughts depend on knowledge about objects, people, properties, and events. In order to think about where we left our keys, what we are going to make for dinner, when we last fed the dogs, and how we are going to survive our next visit with our family, we need to know something about locations, keys, cooking, dogs, survival, families, and so on. Researchers have sought to explain how our brains can store and access such general knowledge. A growing body (...) of evidence suggests that many of our concepts are grounded in action, emotion, and perception systems. We appear to think about the world by means of the same mechanisms that we use to experience it. Abstract concepts like ‘democracy,’ ‘fermion,’ ‘piety,’ ‘truth,’ and ‘zero’ represent a clear challenge to this idea. Given that they represent a uniquely human cognitive achievement, answering the question of how we acquire and use them is central to our ability to understand ourselves. This book argues that abstract concepts are heterogeneous and pose three important challenges to embodied cognition. They force us to ask: How do we generalize beyond the specifics of our experience? How do we think about things that we do not experience directly? How do we adapt our thoughts to specific contexts and tasks? It argues that a successful theory of grounding must embrace multimodal representations, hierarchical architecture, and linguistic scaffolding. Abstract concepts are the product of an elastic mind. Recently, there has been a great deal of interest in the idea that natural language enhances and extends our cognitive capabilities. Supporters of embodied cognition have been particularly interested in the way in which language may provide a solution to the problem of abstract concepts. Toward this end, some have emphasized the way in which language may act as form of cognitive scaffolding and others have emphasized the potential importance of language-based distributional information. This essay defends a version of the (...) cognitive enhancement thesis that integrates and builds on both of these proposals. I argue that the embodied representations associated with language processing serve as a supplementary medium for conceptual processing. The acquisition of a natural language provides a means of extending our cognitive reach by giving us access to an internalized combinatorial symbol system that augments and supports the context-sensitive embodied representational systems that exist independently of language. This article investigates a high-profile and ongoing dilemma for healthcare professionals, namely whether the existence of a duty of care to genetic relatives of a patient is a help or a hindrance in deciding what to do in cases where a patient’s genetic information may have relevance to the health of the patient’s family members. The English case ABC v St George’s Healthcare NHS Trust and others considered if a duty of confidentiality owed to the patient and a putative duty (...) of care to the patient’s close relatives could coexist in this context. This article examines whether embracing the concept of coexisting duties could enable HCPs to respect duties in line with their clinical judgement, thereby providing legal support and clarity to professionals to allow them to provide the best possible genetics service to both the patient and their family. We argue that these dual duties, framed as a novel, composite duty to consider the interests of genetic relatives, could allow HCPs to exercise and act on their professional judgements about the relative value of information to family members, without fears of liability for negligence or breach of confidence. BackgroundCommentators believe that the ethical decision-making climate is instrumental in enhancing interprofessional collaboration in intensive care units. Our aim was twofold: to determine the perception of the ethical climate, levels of moral distress, and intention to leave one's job among nurses and physicians, and between the different ICU types and determine the association between the ethical climate, moral distress, and intention to leave.MethodsWe performed a cross-sectional questionnaire study between May 2021 and August 2021 involving 206 nurses and physicians in a (...) large urban academic hospital. We used the validated Ethical Decision-Making Climate Questionnaire and the Measure of Moral Distress for Healthcare Professionals tools and asked respondents their intention to leave their jobs. We also made comparisons between the different ICU types. We used Pearson's correlation coefficient to identify statistically significant associations between the Ethical Climate, Moral Distress, and Intention to Leave.ResultsNurses perceived the ethical climate for decision-making as less favorable than physicians. They also had significantly greater levels of moral distress and higher intention to leave their job rates than physicians. Regarding the ICU types, the Neonatal/pediatric unit had a significantly higher overall ethical climate score than the Medical and Surgical units and also demonstrated lower moral distress scores and lower “intention to leave” scores compared with both the Medical and Surgical units. The ethical climate and moral distress scores were negatively correlated ; moral distress and "intention to leave" was positively correlated ; and ethical climate and “intention to leave” were negatively correlated.ConclusionsSignificant differences exist in the perception of the ethical climate, levels of moral distress, and intention to leave between nurses and physicians and between the different ICU types. Inspecting the individual factors of the ethical climate and moral distress tools can help hospital leadership target organizational factors that improve interprofessional collaboration, lessening moral distress, decreasing turnover, and improved patient care. Advocates for re-localizing food systems often encourage consumers to support local farmers and strengthen local food economies. Yet, local food systems hinge not only on consumers’ willingness to buy local food but also on whether farmers have the social support networks to address diverse challenges during food production and distribution. This study characterizes the challenges and support systems of farmers selling to local markets in Québec, Canada, across multiple growing seasons using a mixed-methods research design. We sent an online questionnaire (...) to 1046 farmers and conducted follow-up interviews with 15 of the 133 respondents. Our findings show that farmers relied on an average of four support actor groups, particularly employees, customers, and other farmers. Actors played distinct roles in terms of the importance, frequency, and formality of interactions, providing immediate and long-term support through formal and informal relationships across multiple spatial scales (farm, local community, and regional/international). Our thematic analysis showed that support actors helped farmers in four key domains: (1) Knowledge sharing and emotional support; (2) Labour and workforce; (3) Material and financial aid; and (4) Consumer education and business promotion. Farmer associations provided resources to tackle various challenges, acting as bridges across multiple support actor groups. Yet, our results suggest that political desires to encourage local food systems are in some cases poorly matched with resources to address specific types of challenges farmers face. Specifically, overlooking the role of diverse social support actors in helping farmers build food production and distribution capacity could undermine efforts to foster localization. (shrink)

Philosophers have traditionally treated physicalism as an empirically informed metaphysical thesis. This approach faces a well-known problem often referred to as Hempel’s dilemma: formulations of physicalism tend to be either false or indeterminate. The generally preferred strategy to address this problem involves an appeal to a hypothetical complete and ideal physical theory. After demonstrating that this strategy is not viable, I argue that we should redefine physicalism as an interdisciplinary research program seeking to explain the mental in terms of the (...) physical that encompasses the physical sciences, the psychological and brain sciences, and philosophy. Redefining physicalism in this way improves upon previous reconstructive accounts while avoiding the indeterminacy associated with orthodox forms of futurist physicalism. (shrink)

Spurred by a confluence of factors, most notably the decreasing cost of high-throughput technologies and advances in information technologies, a number of population research initiatives have emerged in recent years. These include large-scale, internationally collaborative genomic projects and biobanks, the latter of which can be defined as an organized collection of human biological material and associated data stored for one or more research purposes. Life sciences research is increasingly international and data-intensive. Researchers work in multi-jurisdictional teams or formally established research consortia to exchange data and conduct research using computation of multiple sources and volumes of data at multiple sites and through multiple pathways. Despite the internationalization and data intensification of research, the same ethics review process as applies to single-site studies in one country tends to apply to multi-site studies in multiple countries. Because of the standard requirement for multi-jurisdictional or multi-site ethics review, (...) international research projects are subjected to multiple ethics reviews of the same research protocol. Despite the growing importance of ‘social value’ as a central feature of research ethics, the term remains both conceptually vague and to a certain extent operationally rigid. And yet, perhaps because the rhetorical appeal of social value appears immediate and self-evident, the concept has not been put to rigorous investigation in terms of its definition, strength, function, and scope. In this article, we discuss how the anthropological concept of liminality can illuminate social value and differentiate and reconfigure its variegated approaches. (...) Employing liminality as a heuristic encourages a reassessment of how we understand the mobilization of ‘social value’ in bioethics. We argue that social value as seen through the lens of liminality can provide greater clarity of its function and scope for health research. Building on calls to understand social value as a dynamic, rather than a static, concept, we emphasize the need to appraise social value iteratively throughout the entire research as something that transforms over multiple times and across multiple spaces occupied by a range of actors. In this paper, I assume, perhaps controversially, that translation into a language of formal logic is not the method by which mathematicians assess mathematical reasoning. Instead, I argue that the actual practice of analyzing, evaluating and critiquing mathematical reasoning resembles, and perhaps equates with, the practice of informal logic or argumentation theory. It doesn’t matter whether the reasoning is a full-fledged mathematical proof or merely some non-deductive mathematical justification: in either case, the methodology of assessment overlaps to a large extent (...) with argument assessment in non-mathematical contexts. I demonstrate this claim by considering the assessment of axiomatic or deductive proofs, probabilistic evidence, computer-aided proofs, and the acceptance of axioms. I also consider Jody Azzouni’s ‘derivation indicator’ view of proofs because it places derivations—which may be thought to invoke formal logic—at the center of mathematical justificatory practice. However, when the notion of ‘derivation’ at work in Azzouni’s view is clarified, it is seen to accord with, rather than to count against, the informal logical view I support. Finally, I pose several open questions for the development of a theory of mathematical argument. (shrink)

The Phenomenal Concept Strategy offers the physicalist perhaps the most promising means of explaining why the connection between mental facts and physical facts appears to be contingent even though it is not. In this article, we show that the large body of evidence suggesting that our concepts are often embodied and grounded in sensorimotor systems speaks against standard forms of the PCS. We argue, nevertheless, that it is possible to formulate a novel version of the PCS that is thoroughly in (...) keeping with embodied cognition, focuses on features of physical concepts, and succeeds in explaining the appearance of contingency. Graeme Laurie stepped down from the Chair in Medical Jurisprudence at the University of Edinburgh in 2019. This edited collection pays tribute to his extraordinary contributions to the field. Graeme has often spoken about the importance of 'legacy' in academic work and has forged a remarkable intellectual legacy of his own, notably through his work on genetic privacy, human tissue and information governance, and on the regulatory salience of the concept of liminality. The essays in this volume animate the concept (...) of legacy as lens of analysis for the study and practice of medical jurisprudence. In this light, legacy reveals characteristics of both benefit and burden, as both an encumbrance to and facilitator of the development of law, policy and regulation. Overall, the contributions reconcile the ideas of legacy and responsiveness and show that both dimensions are critical to achieve and sustain the health of medical jurisprudence itself as a dynamic, interdisciplinary and policy-engaged field of thinking. The collapse of confidence in anonymization as a robust approach for preserving the privacy of personal data has incited an outpouring of new approaches that aim to fill the resulting trifecta of technical, organizational, and regulatory privacy gaps left in its wake. In the latter category, and in large part due to the growth of Big Data–driven biomedical research, falls a growing chorus of calls for criminal and penal offences to sanction wrongful re-identification of “anonymized” data. This chorus cuts across (...) the fault lines of polarized privacy law scholarship that at times seems to advocate privacy protection at the expense of Big Data research or vice versa. Focusing on Big Data in the context of biomedicine, this article surveys the approaches that criminal or penal law might take toward wrongful re-identification of health data. It contextualizes the strategies within their respective legal regimes as well as in relation to emerging privacy debates focusing on personal data use and data linkage and assesses the relative merit of criminalization. We conclude that this approach suffers from several flaws and that alternative social and legal strategies to deter wrongful re-identification may be preferable. (shrink)

While ethical norms for conducting academic research in the United Kingdom are relatively clear, there is little empirical understanding of how university research ethics committees (RECs) themselves operate and whether they are seen to operate well. In this article, we offer insights from a project focused on the Scottish university context. We deployed a three-sided qualitative approach: (i) document analysis; (ii) interviews with REC members, administrators, and managers; and (iii) direct observation of REC meetings. We found that RECs have diverse (...) operation and vary in terms of what members understand to be the remit of their REC and what should constitute the content of ethics review. Overall, though, most participants perceive university RECs as operating well. When asked what they consider to be areas for further improvement, most commented on: implementation of an online system; more experience with how to evaluate various kinds of research projects; best practice exchange and training opportunities; more accurate reflection of the REC role as part of the university’s workload allocation model; and greater recognition of the importance of research ethics governance in the university’s research environment, and, for the members themselves, their career advancement. Based on our findings and subsequent discussions during an end-of-project roundtable with stakeholders, we propose a model of collaboration that can address some of the identified areas that could benefit from further improvement. This model would facilitate a heightened awareness of the importance of supporting REC members in their own effort in assisting students and staff alike in undertaking as ethically robust research as possible. This article argues in general support of the sIRB rule, but also draws on recent empirical research to highlight several residual weaknesses in the US regulatory structure for research ethics review, and suggests ways in which these weaknesses might be addressed in future regulatory reforms to improve upon the sIRB rule.

As the sustained and devastating extent of the coronavirus disease 2019 pandemic becomes apparent, a key focus of public scrutiny in the UK has centred on the novel legal and regulatory measures introduced in response to the virus. When those measures were first implemented in March 2020 by the UK Government, it was thought that human rights obligations would limit excesses of governmental action and that the public had more to fear from unwarranted intrusion into civil liberties. However, within the (...) first year of the pandemic’s devastation in the UK, a different picture has emerged: rather than through action, it is governmentalinactionthat has given rise to greater human rights concerns. The UK Government has been roundly criticized for its inadequate response, including missteps in decision-making, delayed implementation and poor enforcement of lockdown measures, abandonment of testing, shortages of critical resources and inadequate test and trace methods. In this article, we analyse the UK Government’s missteps and compare them with published international guidance; we also contrast the UK’s decisions with those taken by several other countries to understand how its actions and inactions have contributed to unfavourable outcomes. Using an analytical perspective that demonstrates how human rights are both a protection from the power of the state and a requirement that governmental powers are used to protect the lives, health and wellbeing of citizens, we argue that the UK Government’s failure to exercise their powers competently allowed the virus to spread without ensuring the country had the means to manage a high case load. This abject failure has led to one of the highest rates of deaths per capita worldwide. We offer several lessons that can be learnt from this unfortunate, but preventable, situation. (shrink)

I argue that a basic similarity analysis of analogical reasoning handles many apparent cases of visual analogy. I consider how the visual and verbal elements interact in analogical cases. Finally, I offer two analyses of visual elements. One analysis is evidential. The visual elements are evidence for their ver-bal counterparts. One is non-evidential: the visual elements link to verbal elements without providing evi-dence for those elements. The result is to make more room for the logical analysis of visual argumentation.

The role played by language in our cognitive lives is a topic at the centre of contemporary debates in cognitive (neuro)science. In this paper we illustrate and compare two theories that offer embodied explanations of this role: the WAT (words as social tools) and the LENS (language is an embodied neuroenhancement and scaffold) theories. WAT and LENS differ from other current proposals, because they connect the impact of the neurologically realized language system on our cognition to the ways in which (...) language shapes our interaction with the physical and social environment. Examining these theories together, their tenets and supporting evidence, sharpens our understanding of each, but also contributes to a better understanding of the contribution that language might make to the acquisition, representation and use of abstract concepts. Here we focus on how language provides a source of inner grounding, especially metacognition and inner speech, and supports the flexibility of our thought. Overall, the paper outlines a promising research program focused on the importance of language to abstract concepts within the context of a flexible, multimodal, and multilevel conception of embodied cognition. More and more researchers are examining grammar acquisition from theoretical perspectives that treat it as an emergent phenomenon. In this essay, I argue that a robustly developmental perspective provides a potential explanation for some of the well-known crosslinguistic features of early child language: the process of acquisition is shaped in part by the developmental constraints embodied in von Baer’s law of development. An established model of development, the Developmental Lock, captures and elucidates the probabilistic generalizations at the heart of von (...) Baer’s law. When this model is applied to the acquisition of grammar, it predicts that grammatical achievements that are more generatively entrenched will emerge earlier in development and will be more developmentally resilient than those that are less generatively entrenched. I show that the first prediction is supported by a wealth of psycholinguistic evidence involving typically developing children and that the second prediction is supported by numerous studies involving both children who receive deficient linguistic input and children who experience various language impairments. The success of this model demonstrates the analytic potential of a developmental approach to the study of language acquisition. (shrink)

What role does language play in our thoughts? A longstanding proposal that has gained traction among supporters of embodied or grounded cognition suggests that it serves as a cognitive scaffold. This idea turns on the fact that language—with its ability to capture statistical regularities, leverage culturally acquired information, and engage grounded metaphors—is an effective and readily available support for our thinking. In this essay, I argue that language should be viewed as more than this; it should be viewed as a (...) neuroenhancement. The neurologically realized language system is an important subcomponent of a flexible, multimodal, and multilevel conceptual system. It is not merely a source for information about the world but also a computational add-on that extends our conceptual reach. This approach provides a compelling explanation of the course of development, our facility with abstract concepts, and even the scope of language-specific influences on cognition. (shrink)

Two versions of the GRW “hitting” model for explicit wavefunction collapse, which are consistent with preserving the symmetry of the wavefunction, are considered. The predictions of the models for excitation of bound systems are calculated and compared with experiment and with the predictions of other similar models. It is shown that our preferred model strongly supports the idea that collapse, if it occurs, has gravitational origin.

In this article, we consider the possible application of the European General Data Protection Regulation to “citizen scientist”-led health research with mobile devices. We argue that the GDPR likely does cover this activity, depending on the specific context and the territorial scope. Remaining open questions that result from our analysis lead us to call for lex specialis that would provide greater clarity and certainty regarding the processing of health data by for research purposes, including these non-traditional researchers.
