Tench Coxe, a member of the second rank of this nation's Founders and a leading proponent of the Constitution and the Bill of Rights, wrote prolifically about the right to keep and bear arms. In this Article, the authors trace Coxe's story, from his early writings in support of the Constitution, through his years of public service, to his political writings in opposition to the presidential campaigns of John Adams and John Quincy Adams. The authors note that Coxe described the (...) Second Amendment as guaranteeing an individual right, and believed that an individual right to bear arms was necessary for self-defense and hunting, as well as for militia purposes and protection against oppression by large standing armies. The views of this important Founding Era political commentator and public servant inform the ongoing Second Amendment debate. The authors argue that Coxe's depiction of an individual right to bear arms encompassing hunting, self-defense, and the public militia power supports the "Standard Model" of the Second Amendment prevalent in the legal literature. This Article also discusses Coxe's important role as an economic scholar in early America, and in the creation of the protectionist system of the early Republic, as both an journalistic advocate and as an executive branch official. One of his executive branch positions involved heading the federal government program to give guns to militiamen who could not afford their own. (shrink)

It is not often that one is graced with a mini-symposium upon reception of an article for publication, and for this I am grateful to Bill Hasker, who had to wait until after his editorship to respond to my provocative piece, and equally grateful to Richard Cross, whom Bill solicited for an assist. Since my piece called for a “radical transformation of standard philosophical strategies,” and Bill addressed that perspectival issue from the outset, while Richard focused on some axial semantic (...) and epistemological contentions, I shall begin with Bill Hasker’s overall puzzlements, proceed to address some issues on which Richard Cross and I seem fated to disagree, and close by addressing the neuralgic point of created freedom, which both Hasker and I find axial to attempting to articulate the creator/creature relation. What gratifies me is the opportunity to interact with such sterling critics, and to try to ascertain whether we can advance a discussion (as Bill Hasker suggests) of issues which no sane human inquirer can ever pretend to “get right.”. Federal credit policies toward agriculture reflect the human values of maintaining the farm production sector largely as an industry characterized by small-scale, family farms. The Farmers Home Administration has implemented various credit programs designed to carry out this policy objective. As a result of the prolonged financial crisis in the farm economy, the agricultural community is becoming more aware of the controversies surrounding the mission of FmHA and its debt restructuring program. This paper discusses the debt restructuring program administered by (...) the Farmers Home Administration (FmHA), as authorized by the Agricultural Credit Act of 1987, and amended by the recently enacted Farm Bill of 1990. It discusses the key provisions of the Agricultural Credit Act authorizing FmHA to establish a debt restructuring and debt forgiveness program aimed at achieving the public policy objective of keeping financially stressed farmers in business, whenever possible.In the course of reviewing the restructuring program, FmHA officials and congressional committees reviewed the FmHA's mission and its program implementation. This review indicated that several unintended negative consequences resulted from several abuses stemming from inadequate administrative mechanisms and controls and conflicting legislative objectives of debt forgiveness and federal tax policy. In enacting the 1990 Farm Bill, Congress sought to reorient FmHA's mission to a temporary source of credit and to eliminate various abuses associated with the implementation of FmHA's debt restructuring program. The 1990 Farm Bill reflects an effort by Congress to address some the controversies surrounding federal credit policies toward agriculture. Although Congress placed limits on debt restructuring, the overall public policy objective of maintaining a family-farm posture in the agricultural sector continues to be an important social value. Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

It is worthwhile comparing Hylomorphic and Animalistic accounts of personal identity since they both identify the human animal and the human person.The topics of comparison will be three: The first is accounting for our intuitions in cerebrum transplant and irreversible coma cases. Hylomorphism, unlike animalism, appears to capture “commonsense” beliefs here, preserves the maxim that identity matters, and does not run afoul of the Only x and y rule. The next topic of comparison reveals how the rival explanations of transplants (...) and comas are both at odds with some compelling biological assumptions. The third issue deals with our practical concerns, most notably, the possibility of an afterlife. It turns out that the hylomorphic treatment of Purgatory raises the spectra of the “too many thinkers” problem and some considerable unfairness. Contrary to expectations, an animalist insistence on uninterrupted bodily continuity between this life and the next does not involve deceptive body snatching. (shrink)

The use of a person's distinctive genetic data to guide treatment and to forestall disease--called "personalized medicine"-- reflects how the molecular gaze can produce valuable advances in biomedical healthcare. Although the predominant view is that vagueness is due to our language being imprecise, the alternative idea that objects themselves do not have determinate borders has received an occasional hearing. But what has failed to be appreciated is how this idea can avoid a puzzle Peter Unger named “The Problem of the Many.”[i].

Ivan Boh affirms and Robert Pasnau denies that William Heytesbury holds merely true belief to be sufficient for knowledge in the broad sense. I argue that Boh is correct and Pasnau is mistaken, and that there is a long-running orthodox medieval tradition agreeing with Heytesbury about the conditions for knowledge. I offer a hypothesis about the origins, continuance and demise of that medieval tradition, and some remarks about the tradition's significance.

In this collection, Stations on the Journey of Inquiry, David Burrell launches a revolutionary reinterpretation of how any inquiry proceeds, boldly critiquing presumptuous theories of knowledge, language, and ethics. While his later publications, Analogy and Philosophical Language (1973) and Aquinas: God and Action (1979), elucidate Aquinas's linguistic theology, these early writings show what often escapes articulation: how one comes to understanding and "takes" a judgment. Although Aquinas serves as an axial figure for Burrell's expansive corpus of scholarship spanning more (...) than fifty years, this selection of essays presents other positions and counterpositions to whom his own philosophical theology is beholden: Plato, Aristotle, Cajetan, Kant, Peirce, Moore, Wittgenstein, Sellars, Weiss, Ross, McInerny, and Lonergan. With renewed interest in philosophy of language by postmodern thinkers as well as in the wake of Mulhall's Stanton Lectures on Wittgenstein and "Grammatical Thomism," the publication of these formative writings proves timely for the academy at large. Essays on the History and Philosophy of Science by David B. Levy.

Do psychological traits predict philosophical views? We administered the PhilPapers Survey, created by David Bourget and David Chalmers, which consists of 30 views on central philosophical topics (e.g., epistemology, ethics, metaphysics, philosophy of mind, and philosophy of language) to a sample of professional philosophers (N = 314). We extended the PhilPapers survey to measure a number of psychological traits, such as personality, numeracy, well-being, lifestyle, and life experiences. We also included non-technical ‘translations’ of these views for eventual use (...) in other populations. We found limited to no support for the notion that personality or demographics predict philosophical views. We did, however, find that some psychological traits were predictive of philosophical views, even after strict correction for multiple comparisons. Findings include: higher interest in numeracy predicted physicalism, naturalism, and consequentialism; lower levels of well-being and higher levels of mental illness predicted hard determinism; using substances such as psychedelics and marijuana predicted non-realist and subjectivist views of morality and aesthetics; having had a transformative or self-transcendent experience predicted theism and idealism. We discuss whether or not these empirical results have philosophical implications, while noting that 68% of our sample of professional philosophers indicated that such findings would indeed have philosophical value. I raise issues concerning Jones' Seneca analysis, its relationship to analyses of Dravidian-, Crow-, and Omaha-type systems. These affect the convincingness of his kinship study, and thus the wider conclusions that he wants to draw regarding human cognition and language.

Evidence suggests that psychedelics bring about their therapeutic outcomes in part through the subjective or qualitative effects they engender and how the individual interprets the resulting experiences. However, psychedelics are contraindicated for individuals who have been diagnosed with certain mental illnesses, on the grounds that these subjective effects may be disturbing or otherwise counter-therapeutic. Substantial resources are therefore currently being devoted to creating psychedelic substances that produce many of the same biological changes as psychedelics, but without their characteristic subjective effects. (...) In this article, we consider ethical issues arising from the prospect of such potential “nonsubjective” psychedelics. We are broadly supportive of efforts to produce such substances for both scientific and clinical reasons. However, we argue that such nonsubjective psychedelics should be reserved for those special cases in which the subjective effects of psychedelics are specifically contraindicated, whereas classic psychedelics that affect subjective experience should be considered the default and standard of care. After reviewing evidence regarding the subjective effects of psychedelics, we raise a number of ethical concerns around the prospect of withholding such typically positive, meaningful, and therapeutic experiences from most patients. In the Summer of 2020, a couple of months after the start of the Covid-19 crisis, the Franciscan Study Center at Tilburg University and the Franciscan Institute at St. Bonaventure University started a new partnership called Franciscan Connections. The aim of this new international Franciscan blog was to connect, communicate, and convey the best of Franciscan learning in the twenty-first century. We decided that we wanted to make contemporary and applied Franciscan scholarship available to a wider world of scholars, educated (...) professionals, and communities of practice and to make a new generation of readers aware of the contribution that Franciscan scholarship can make on contemporary issues in politics, society, ethics, and church. Now, almost two years and 200 blog posts later, we notice an increasing involvement from people around the world that seem to really appreciate this new platform as a means for establishing all kinds of Franciscan-inspired connections. Grafted on a way of life inspired by a vision of equality and justice, the Franciscan ethos displays a wealth of values and virtues that are conducive to moral goodness and concern for the common good. As a gift of the Highest Good, Franciscan goodness becomes both a social good and a personal virtue. It is inextricably bound to other social goods like charity, poverty, and peace, which, unsurprisingly, are personal virtues as well. They are also evangelical goods and virtues. Their evangelical rootedness and interconnectedness should therefore be borne in mind, when the Franciscan way of life is to be presented as a primary example of "the good life.". (shrink)

In the wake of Republican gains in November 2010, anti-abortion bills were common and aggressive during the 2011 legislative sessions.1 State general assemblies passed statutes that include provisions to (a) block abortions after twenty weeks of gestation, (b) require doctors to tell pregnant women that fetuses feel pain at or before twenty weeks of gestation, (c) prevent state or federal health care dollars from reaching clinics and physician groups that provide abortions as part of their services,2 and (d) require (...) doctors to describe the ultrasound images of the fetus and offer women the option to view the ultrasound and listen to the fetal heartbeat before an abortion.3 These statutes are troubling .. This book is a selection of articles by David Zilberman, a prolific author, whose tragic untimely death did not allow to finish many of his undertakings. Zilberman’s work represents a fresh word in the way of philosophizing or philosophy-building and the technique of modal methodology. This book comprises of thirteen independent articles that are not related by content. The point of thematic convergence of these articles is the way they reflect the new way of methodological thinking through the application (...) and benefits of modalization or modal methodology that unfolds unbound possibilities of philosophic elaborations. By shifting constantly from one position to another, Zilberman disclosed the antinomicity of all types of thought. Such an approach led him to outline for the first time his major attempt to start creating not "systems" but "sums" of philosophies so that the philosophical activity would be able to re-emerge on the slopes of such "sums." The book can be used as a starting point of a discussion, especially in study of philosophy. We imagine it can be used in undergraduate classes on World Philosophies or Intercultural Philosophy courses. With that, it can serve as a useful resource for adding intercultural elements into Western-centered courses. (shrink)

Wong proposes that there can be a plurality of true moralities, moralities that exist across different traditions and cultures, all of which address facets of the same problem: how we are to live well together. Wong examines a wide array of positions and texts within the Western canon as well as in Chinese philosophy, and draws on philosophy, psychology, evolutionary theory, history, and literature, to make a case for the importance of pluralism in moral life, and to (...) establish the virtues of acceptance and accommodation. Wong's point is that there is no single value or principle or ordering of values and principles that offers a uniquely true path for human living, but variations according to different contexts that carry within them a common core of human values. However, there is a dark side to the influx of money into science. Unbridled pursuit of financial gain in science can undermine scientific norms, such as objectivity, honesty, openness, respect for research (...) participants, and social responsibility. In The Price of Truth, David B. Resnik examines some of the important and difficult questions resulting from the financial and economic aspects of modern science. David Annis is professor of philosophy at Ball State University. In this essay, Annis offers an alternative to the foundationalist-coherent controversy: "contextualism." This theory rejects both the idea of intrinsically basic beliefs in the foundational sense and the thesis that coherence is sufficient for justification. he argues that justification is relative to the varying norms of social practices.

This book provides a framework for approaching ethical and policy dilemmas in research with human subjects from the perspective of trust. It explains how trust is important not only between investigators and subjects but also between and among other stakeholders involved in the research enterprise, including research staff, sponsors, institutions, communities, oversight committees, government agencies, and the general public. The growing interest in Africa as well as concerns about negative deviant behaviors and ethnic structures necessitates examination of the effect of ethnic expectations on behavior of employees. In this study we leverage insight from ethnos oblige theory to propose that centralization of ethnic norms moderates the relationship between benevolence expectations and negative deviant behavior. Using a cross-sectional design and data from two countries as well as moderation and cross-cultural analytic techniques, we find support for three-way interactions where the relationship (...) between benevolence and negative deviant behavior is moderated by centralization and culture. We discuss the implications of the findings which support the dynamic perspective of management in Africa. (shrink)
