Corruption poisons corporations in America and around the world, and has devastating consequences for the entire social fabric. In this article, we focus on organizational corruption, described as the abuse of authority for personal benefit, and draw on Weber’s three ideal-types of legitimate authority to develop a theoretical model to better understand the antecedents of different types of organizational corruption. Specifically, we examine the types of business misconduct that organizational leaders are likely to engage in, contingent on their legitimate authority, (...) motives, and justifications. We conclude by suggesting managerial implications of our theoretical model and propose directions for future research. (shrink)

Ten countries have established quotas for female representation on publicly traded corporate and/or state-owned enterprise boards of directors, ranging from 33 to 50 %, with various sanctions. Fifteen other countries have introduced non-binding gender quotas in their corporate governance codes enforcing a “comply or explain” principle. Countless other countries’ leaders and policy groups are in the process of debating, developing, and approving legislation around gender quotas in boards. Taken together, gender quota legislation significantly impacts the composition of boards of directors (...) and thus the strategic direction of these publicly traded and state-owned enterprises. This article outlines an integrated model of three institutional factors that explain the establishment of board of directors gender quota legislation based on the premise that the country’s institutional environment co-evolves with gender corporate policies. We argue that these three key institutional factors are female labor market and gendered welfare state provisions, left-leaning political government coalitions, and path-dependent policy initiatives for gender equality, both in the public realm as well as in the corporate domain. We discuss implications of our conceptual model and empirical findings for theory, practice, policy, and future research. These include the adoption and penalty design of board diversity practices into corporate practices, bottom-up approaches from firm to country-level gender board initiatives, hard versus soft regulation, the leading role of Norway and its isomorphic effects, the likelihood of engaging in decoupling, the role of business leaders, and the transnational and international reaction to board diversity initiatives. ABSTRACT:Despite a significant increase in whistle-blowing practices in work organizations, we know little about what differentiates whistle-blowers from those who observe a wrongdoing but chose not to report it. In this review article, we first highlight the arenas in which research on whistle-blowing has produced inconsistent results and those in which the findings have been consistent. Second, we propose that the adoption of an identity approach will help clarify the inconsistent findings and extend prior work on individual-level motives behind whistle-blowing. (...) Third, we argue that the integration of the whistle-blowing research with that on ethics programs will aid in systematically expanding our understanding of the situational antecedents of whistle-blowing. In this 60th anniversary of Business & Society essay, we seek to make three main contributions at the intersection of governance and artificial intelligence. First, we aim to illuminate some of the deeper social, legal, organizational, and democratic challenges of rising AI adoption and resulting algorithmic power by reviewing AI research through a governance lens. Second, we propose an AI governance framework that aims to better assess AI challenges as well as how different governance modalities can support AI. At the (...) heart of our framework lies the governance forces that apply to institutions, organizations, and individuals, who ultimately provide, regulate, and use AI decision-making. We discuss how businesses may harness AI’s economic power through governance solutions without creating or amplifying societal biases and inequalities. Third, as part of our section on future research, we identify a set of governance trade-offs in AI adoption, suggest future research avenues to conceptually strengthen research on the governance of AI, and lay out key policy recommendations. White-collar crimes are illegal and unethical actions by agents of an organization. In this paper, we address two related research questions concerning white-collar crime—how did the language of white-collar crime evolve? And how did this language co-evolve with the investigation of white-collar crime? Building on research on institutional work, we find that key institutional actors such as the Presidential Office are likely to use frames and adopt a particular language in order to legitimize institutional practices . Conversely, less powerful actors (...) such as the law enforcement agencies are then likely to use narratives to shape language in order to mobilize other stakeholders to continue the adoption of the referent practice. We uncover these findings by using qualitative methodology and trend analysis. We conclude with a detailed theoretical discussion of the role of institutional actors in institutional work and the implications of our research. (shrink)

ABSTRACTNon-suicidal self-injury is commonly used by young adults to regulate emotional responses. Yet, experimental examination of how people who self-injure appraise and respond to emotional stimuli is limited. We examined appraisals of, and responses to, emotive images in young adults who did and did not self-injure, and assessed whether these were impacted by exposure to a stressor. Study 1 examined whether participants differed in their appraisals of emotional images. Study 2 assessed whether appraisals of images changed after exposure to the (...) Trier Social Stress Test. Ratings of emotional valence and arousal were collected in both studies; skin conductance was measured as an indicator of physiological arousal in Study 2. In Study 1 participants reporting NSSI rated positively valenced images as less pleasant than participants not reporting NSSI. The provision of basic primary health care services to all people is the key to eliminating the gross inequities in health status existing in many countries. For many years nurses in developing countries have ‘led the way’ in bringing these essential services to poor rural communities, including the diagnosis and treatment of illnesses, and the prescribing and dispensing of medications. Nurses (...) are the most appropriate health workers for this role, but most have not been prepared adequately for it. This is unsafe for patients and puts nurses at legal risk. Justice requires that patients should obtain access to safe health care and that nurses should receive appropriate education. Nurse practitioner programmes are being established to prepare nurses for this advanced practice role, but here again ethical considerations apply. Justice will be served only if nurse practitioner programmes are accessible to the nurses who are most likely to work in medically underserved communities where the need is greatest. (shrink)

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. The Family Planning Association Northern Ireland (F.P.A.N.I.) has recently been successful in holding the state accountable for its duty to safeguard women’s reproductive health and welfare, and clarify the circumstances in which abortion is lawful. By demanding that the Minister for Health investigate abortion provision and produce abortion guidance, F.P.A.N.I. hope to improve the quality of abortion services and alleviate the situation of those women who are legally entitled to abortion in Northern Ireland but cannot access it there. This action (...) has challenged a public failure which impacts most negatively on those women who cannot easily escape its effects. Although the case succeeded in shaming the state for such a failure, the judicial review strategy could not challenge the legal ethos which denies women a say over their reproductive lives. This case commentary argues that pro-choice strategic litigation needs to positively and generally assert women’s reproductive rights at the same time as it seeks to accommodate the needs of the most vulnerable. Support of the conclusions requires some discussion of substitution puzzles; also, the semantical distinction between proper names which are directly referring, and descriptions even where the latter are "rigid designators". ABSTRACT This paper examines a relationship between heresy and utopianism forged in nineteenth- and early twentieth-century socialist histories to reveal a significant, pervasive fault-line in the ideological construction of anarchism. It first looks at Marxist narratives which trace the lineages of socialism back to medieval religious dissent and argues that a sympathetic assessment of European heretical movements was qualified by a critique of utopianism, understood as the rejection of materialist ‘science’. It then argues that strands of this narrative have been (...) woven into anarchism, looking at three examples: E.V. Zenker’s Anarchism (1897), James Joll’s The Anarchists (1964/1979) and Saul Newman’s From Bakunin to Lacan (2001). The dominant theme is that anarchism promises the transformation of corrupted nature and aims to achieve it though ecstatic violence, cataclysmic revolution and future perfection. Although this Millenarian anarchism is a ‘straw man’, rather than jettison ‘heresy’ as an investigative tool, I prefer an alternative conception of heresy derived from Martin Buber’s analysis of utopianism in Paths in Utopia (1949) and Michael Bakunin’s critique of political theology. I relate utopianism to the rejection of perfection and heresy with faith. By reframing of heresy in this way I seek to correct a long-standing distortion of anarchist ideas. (shrink)

BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

This paper examines the English case, Regina v Adams in which the difference between "scientific reason" and "common sense" was explicitly at stake in the use of DNA evidence. In its decision the Appellate Court reinstated a boundary between "scientific" and "common sense" evidence, arguing that this boundary was necessary to preserve the jury's role as trier of fact. The paper's discussion of the court's work of demarcation addresses the unresolved problems with the place of probability estimates in jury trials.

Recent statistics in South Africa shows that women mostly experience poverty as compared to their male counterparts. In the context of the experience of poverty by women, several Old Testament scholars have convincingly explored the theme of poverty in the Hebrew Bible. In her contextual rereading of the Naomi-Ruth Story, Madipoane Masenya links the issue of poverty to the theme of land. Also, from the historical-critical and partly, the contextual approach to ancient texts, Esias E. Meyer argues that Leviticus (...) 25:8-55 holds liberating possibilities for women who are invisible in such a text. Based on the argument made by the preceding scholars, firstly, this article argues that in the context from which the texts of Ruth 4 and Leviticus 25:8-55 emerged, some women were both landless and poor. Secondly, it is argued in this article that the context of these texts carries a striking resemblance to the situation of women in modern South Africa, as many women do not own productive land and are poor. Thirdly, this article poses the question: What implications do the ideologies of Ernesto 'Che' Guevara and the hermeneutical approach of Fernando F. Segovia to ancient texts bear on the reading of Ruth 4 and Leviticus 25:8-55 in South Africa? (shrink)

ABSTRACT Largely as a result of public outcry, legislation has recently been passed in the UK prohibiting the sale of bodily parts. This topic was the focus of a recent article in Journal of Applied Philosophy by Ruth Chadwick, which acknowledged that difficulties might exist in trying to distinguish between the selling of one's bodily organs and the selling of one's labour. The position argued for, in the ensuing discussion, is that there is no relevant moral difference between the (...) two acts. Furthermore it contests the view that the sale of bodily organs should necessarily be prohibited. The assertion is made that the legislation does little to prevent the general exploitation of the type of person likely to be involved in such transactions, places unnecessary restrictions on the autonomy of individuals, and does nothing to promote an enhanced moral attitude by health professionals. The papers by Nancy Kass, Ruth Faden, and colleagues describe an ethical imperative to study clinical care as it is being delivered. The goal of learning from each patient is attractive, but integrating research and clinical practice is not easy. The authors suggest that the bioethical framework in use for the past forty years to oversee clinical research may be as much an impediment to the development of a learning health care system as a means of protecting the interests (...) of patients. This framework draws a bright line between clinical research and clinical care activities, subjecting clinical research to institutional review and ongoing oversight while assuming that clinical care is conducted primarily in the interests of patients and not in need of additional ethical oversight. The authors identify five characteristics that have been used to distinguish the two activities, and they conclude that none succeed. The practical implications of this conclusion are left unspecified, however. Should ethical oversight simply be eliminated for these kinds of research activities on the grounds that oversight is not mandated for clinical care and the two cannot be distinguished? (shrink)

L’idea che vi sia una netta dicotomia tra fatti e valori è uno dei dogmi dell’empirismo. Secondo questa concezione, i giudizi fattuali, in quanto verificabili o falsificabili empiricamente, riguardano le aree di razionalità «pura» e omogenea e sono ancorati naturalisticamente al mondo. Gli enunciati di valore, invece, sarebbero da relegare nella sfera di ciò che è semplicemente «soggettivo», emotivo, irrazionale. Questo assunto, che ha dominato per molto tempo le scienze e la filosofia, è stato messo in dubbio dai pragmatisti e (...) da alcuni dei più influenti pensatori contemporanei, che, intervenendo al dibattito sull’oggettività dell’etica, hanno mostrato come la presunta eterogeneità tra giudizi descrittivi e giudizi valutativi sia ormai insostenibile. Sulla scia della prospettiva inaugurata da questi pensatori, gli autori di questo libro mostrano come la dicotomia fatto/valore abbia corrotto il nostro pensiero, impedendoci di rivolgere l’attenzione alle intersezioni, le sinergie e le relazioni che esistono tra processi cognitivi e coefficienti valutativi, tra scienza e etica.
