Fas Ahvâl-i Şahsiyye Kanunu üzerinde 2004 yılında yapılan reformlarla birlikte Fas Aile Kanunu (Müdevveneh), İslam dünyasındaki en eşitlikçi kanunlardan biri olarak kabul edilmektedir. Söz konusu reformlar, Fas'ta onlarca yıldır devam eden uzun soluklu kamuoyu tartışmalarının bir ürünü olarak ortaya çıkmıştır. Ahmed el-Hamlîşî 1980'lerin başından itibaren bu tartışmalara aktif olarak katılmış ve Ahvâl-i Şahsiyye Kanunu'nun yoruma açık insan yapımı bir kanun olduğunu ve revizyonunun ictihad yoluyla yapılması gerektiğini savunmuştur. Kral 6. Muhammed tahta çıktıktan kısa bir süre sonra, 2001 yılında, Fas Ahvâl-i (...) Şahsiyye Kanunu'nda reform yapmak üzere Kraliyet Danışma Komisyonu'nu oluşturdu. Kral 6. Muhammed komisyonu, Şeriat'ın temel hedeflerini (makâsıdü'ş-Şeria) gözeterek ve aynı zamanda ictihad yoluyla zamanın ve toplumun ihtiyaçlarına cevap vererek Ahvâl-i Şahsiyye Kanunu’nda önemli değişiklikler yapmakla görevlendirdi. Bununla birlikte, komisyon üyelerini kamu yararını göz önünde bulundurmaya ve önerilen her türlü değişiklikte uzlaşma ve ılımlılık için çaba göstermeye teşvik etti. Komisyon üyeleri önerilen değişiklikler üzerinde yaklaşık iki buçuk yıl çalıştı ancak birçok konuda uzlaşmaya varamadı. Bu bağlamda, üyelerin komisyon içinde oluşan iki ana gruptan reformist ve gelenekçilerden birine, az ya da çok, meylettiği söylenebilir. Ahmed el-Hamlîşî, Kraliyet Danışma Komisyonu'nun üyelerinden biriydi. Komisyon üyeleri arasında reformist grubun değişiklik tekliflerini destekleyen ama aynı zamanda bunu gelenekçilerin benimsediği dili kullanarak yapan etkili ve önemli bir isim oldu. Nitekim, el-Hamlîşî İslam hukuku çerçevesi içinde kalan eleştirel ama ılımlı görüşleriyle aile hukukunun reformunu talep eden gruplar için bir referans noktası haline geldi. Bu çalışmada, Ahmed el-Hamlîşî’nin fıkhi temellendirme ve delillendirme açısından Fas 2004 aile hukuku reformlarının arkasındaki isim olduğu savunulmaktadır. Veri analizi yönteminin uygulandığı bu çalışmada, öncelikli olarak Hamlîşî'nin eserleri, çeşitli mecralardaki mülakatları ve konuşmaları kullanılmıştır. Hamlîşî’nin anlayışındaki farklılık ve benzerlikleri ortaya çıkarmak için literatüre başvurulmuş ve benzer görüşlerle karşılaştırmalar yapılmıştır. Fas Ahvâl-i Şahsiyye Kanunu’nun reformuna dair kısa bir arka plan açıklamasının ardından bu makale, Hamlîşî'nin metin ve bağlam arasındaki arabulucu rolünü, aile hukuku reformları tartışmasındaki yerini ve dolayısıyla Şeriat-devlet ilişkileri konusundaki duruşunu incelemektedir. Daha sonra, ictihad kapısının kapanması meselesi, müctehid olabilmenin şartları, müctehidin nitelikleri ve Kraliyet Danışma Komisyonu tarafından uygulandığı şekliyle kolektif ictihad türü (cemâʿî ictihad) hakkındaki görüşlerine atıfla Hamlîşî’nin ictihad anlayışına odaklanılmaktadır. Son olarak, Hamlîşî'nin akıl yürütme yöntemi ve ortaya koyduğu gerekçeler aile hukuku ile ilgili meseleler örnekliğinde gösterilmektedir. (shrink)

Popüler kültürün oluşturulup güçlendirildiği, dini konuların konuşulduğu ve insanların açık bir şekilde tercihlerini paylaştıkları sosyal medya bugün gençleri doğrudan etkileyen bir araçtır. Dolayısıyla Z kuşağı ergenlik döneminde en fazla aile, değer, din ve kültürel eğitimden daha fazla sosyal medya araçlarındaki influencer etkisi altındadır. Bütün bu bilgiler ışığında; bu araştırmanın amacı, Z kuşağının sosyal medya araçları aracılığıyla oluşturduğu yoğun influencer etkileşiminin dini ve kültürel değerlere olan etkilerini araştırmaktır. Bu araştırmanın önemi, Z Kuşağı ile infleuncer etkileşiminin dini ve kültürel değerlere olan etkisine (...) ilişkin toplumsal anlayışı derinleştirme ve konuya ilişkin bir bakış açısı geliştirilmesinin sağlanmasıdır. Gençlerin gelecek nesiller olduğu temel yargısıyla bu konu geleceğin biçimlendirilmesi açısından önemli görülmektedir. Araştırmanın yöntemi derinlemesine görüşmedir. Sosyal medyayı aktif kullanan ve influencer takip eden 15 Z kuşağı mensubu ile derinlemesine görüşmeler yapılmış ve veri toplanmıştır. Derinlemesine görüşmeler yarı-yapılandırılmış biçimde gerçekleştirilmiştir. Çalışma kapsamında 8 temel soru belirlenmiş ve bu sorulara verilen yanıtlara bağlı olarak ilişkili sorular sorularak yanıtların genişletilmesi hedeflenmiştir. Bu kişiler basit tesadüfi örneklem yöntemi kullanılarak seçilmiş olup hepsi lisans düzeyinde üniversite öğrencisidir. Cinsiyet ve sosyo-ekonomik durum bu araştırma kapsamında bir ayırt etme aracı değildir. Ancak 15 kişinin 9’u kadın ve 6 tanesi de erkeklerden oluşmaktadır. Tüm öğrenciler farklı illerde ikamet etmesine karşın hepsi İstanbul’daki üniversitelerde öğrenimlerini sürdürmektedir. Çalışmada sosyo-ekonomik durum öncelenmemekle beraber bireyin bir akıllı cep telefonuna sahip olması ve sosyal medya araçlarını aktif kullanarak influencerlar ile etkileşim içerisinde olması gerekli görülmüştür. Araştırmanın sonuçlarına göre; bu yaş grubundaki görüşmeciler açık bir şekilde influencerların görüşlerinin kendileri için önemli olduğunu belirtmiştir. Araştırma kapsamında cinsiyet ayırt edici bir unsur olmamasına karşın cinsiyet dayalı öne çıkan bir farklılık saptanmamıştır. Buradaki cinsiyete dayalı en temel farklılık takip edilen influencerların çeşitlenmesi ve değişmesidir. Cinsiyete dayalı sosyal beğeni ve zevklerin burada etkili olduğu düşünülmektedir. Görüşmeciler influencerların dini ve kültürel değerlere uzak paylaşımlarda bulunduklarını da ortaya koymuşlardır. Özellikle bu yaş grubunun Türk olmayan influencerları takip etmeleri de onların kendi kültürleri ve dinlerine yabancılaşarak yabancı din ve kültürlere hayranlık duymasına neden olmaktadır. Bütün görüşmelerin sonucunda, influencer takip eden ve sosyal medyayı aktif kullanan Z kuşağının dini ve kültürel değerlerden uzaklaşarak yaşamlarını daha din dışı ve popüler kültür öğeleri çerçevesinde yaklaştıklarını söylemek mümkündür. Genel olarak tüm sonuçlar değerlendirildiğinde, sosyal medya ve infleuncer etkisiyle gençlik döneminde bireyler dini öğeleri yaşamından uzaklaştırarak seküler bir yaşam tarzını örnek alarak benimseme yaklaşımı göstermektedir. Memlûk Devleti’nin kuruluş yılları ile ilgili literatürde pek çok çalışma mevcuttur. Bunlar genellikle sultanların memlûk kökenli olmalarından dolayı devletin meşruiyeti meselesini merkeze almaktadırlar. Memlûkların bu sorunu aşmak için kendilerini İslam’ın koruyucuları kimliğiyle öne çıkardıkları anlatılmaktadır. Bu anlatıma göre İslam’ın koruyucusu olmak ileride kuracakları müstakil devletlerini meşrulaştıracaktı. Ancak bu argüman, devletin oluşumunu büyük oranda Haçlı-Moğol saldırıları gibi dışsal unsurlara karşı yapılan başarılı mücadelelere bağlamaktadır. Bu durum Memlûk Devleti’nin oluşumunun ardında yatan pek çok nedenin göz ardı edilmesine neden olmaktadır. Devletin dışsal unsurlara (...) karşı yürüttüğü mücadelelerden meşruiyet devşirdiği kabul edilmekle birlikte, bu çalışma, hizipler arası çekişmelere odaklanarak bu mücadeleler dolayısıyla devletin dinamik bir hâl aldığını ortaya koymaktadır. Bu bakımdan Memlûk iktidarının kendi içindeki dönüşümünde Eyyûbîler zamanında beri faal olan hizipler arası mücadele dikkate alınmak durumundadır. Ayrıca Memlûklar’da sıklıkla bahsedilen argümanlar arasında bulunan sultan öldürerek sultan olmak gibi anlatımlar mevcut olmasına rağmen devlet sisteminin işleyişinde herkes tarafından bilinen ve yazılı olmayan kaidelerden olan seçkin emîrlerin belirleyici gücü dikkate alınmalıdır. Zira bu ıskalandığında hizipler arası mücadelelerin getirdiği neticeler de göz ardı edilecektir. Bu kaidelerde/sistemde yalnızca sultan değişmiyor aynı zamanda iktidarda bulunan seçkin elit kadroda da bir dizi değişiklikler hasıl oluyordu. Sultan ve seçkin emîrler arasındaki otokrasi-oligarşi çatışması her daim yaşanmaktaydı. Ne zaman ki oligarşik gücü sağlayan emîrlerden biri sultan olur, işte o zaman sultan ile seçkin emîrler arasında iktidar mücadelesi başlardı. Bu durumda sultan açmazda kalarak otoritesini ihdas edebilmek amacıyla kendisine yeni bir hizip kurardı. Dolayısıyla Memlûk Devleti’nin oluşumu noktasında hizipler arası mücadele devletin oluşumunu ve iktidarın değişimini sağlayan en önemli etkenlerdendi. Nitekim resmen olmasa da de facto olarak Âdiliyye, Kâmiliyye ve Sâlihiyye gibi memlûk hiziplerinin de devlet gücünü ellerinde tuttukları bilinen bir gerçektir. Diğer taraftan bu çalışma, süreç içerisinde Sâlihiyye-Bahriyye memlûklarının devletleşmesini sağlayan koşulları bütünsel bir yaklaşımla ele almaktadır. Ayrıca sultanın memlûkları (el-memâlikü’s-sultaniyye) ile hûşdâşları arasındaki gerilimin iktidarın el değiştirmesini nasıl etkilediğini tartışmaktadır. Spesifik olarak Bahriyye-Muʿizziyye arasındaki mücadeleye odaklanan bu çalışma, Memlûk devletinin kuruluş yıllarında iktidarın oluşumu, sürdürülmesi ve değişiminin nasıl gerçekleştiğini incelemektedir. Son olarak çalışmada genel olarak erken Memlûk dönemine ait kronikler ve hususi olarak Memlûk sultanlık anlayışına hasredilmiş çalışmalar sadedinde sultan-seçkin emîrler arasındaki arka plan çatışmaları, iktidar devşirmeleri vb. hadiselerin devletin oluş-bozuluşunda oynadığı rol esas alınmaktadır. Dil, düşüncelerin ifade edilmesini, bilgi aktarımını ve sosyal etkileşimi sağlayan temel bir olgudur. Dil eğitimi ise kültürler arası iletişimi kolaylaştıran ve dünya genelinde etkili iletişim kurma becerisi kazandıran bir faaliyettir. Birden fazla dil bilmek, farklı kültürlere ve bakış açılarına açık olmayı sağlar. Yaşadığı dünya düzeni içerisinde çağın gerisinde kalmak istemeyen, uygar ve etkileşimli bir toplum olma niyetini taşıyan Fransa hükümet yetkilileri dil eğitimi konusunda ciddi adımlar atmıştır. 1795 yılında Doğu dilleri üzerine uzmanlaş Inalco’yu kurarak başta Osmanlı olmak üzere İslâm dünyasının (...) konuştuğu dili öğrenen uzmanlar yetiştirmeye başlamıştır. Kuruluşundan itibaren sistemli bir şekilde dil yelpazesini genişleten Inalco, Türkçe, Arapça, Çince, Farsça, Hintçe, Japonca, Korece, Rusça, İbranice ve daha birçok Doğu dilini bünyesine katmıştır. Bu dilleri öğrenen ve konuşan kişiler sayesinde Fransa, Doğuyla olan münasebetini güçlü tutmakta ve burada bulunan devletlerle uzaktan yahut yakından temas içerisinde kalmayı sürdürmektedir. Yaklaşık dört asırlık geçmişiyle Inalco, bir dil eğitimi merkezi olmanın yanında şarkiyat kurumları içerisinde önde gelen, sayısız oryantalist yetiştirip çeşitli sahalarda eserlerin yazılmasına imkân tanıyan bir kurumdur. Kuruluş, misyonuna uygun olarak uzun süre Doğu dilleri ve medeniyetleri üzerine uzmanlaşmış öncü isimleri yetiştirip çalışmalarıyla kültürel etkileşimi teşvik etmiş ve kültürler arası anlayışı geliştirmeye yardımcı olmuştur. Kurumsal tecrübesiyle ilgi alanını hep genişleten Inalco günümüzde neredeyse tüm dünya dilleri ve medeniyetleri üzerine çalışmalarını devam ettirmektedir. Artık dil ve kültür alanındaki uzmanlığı ve köklü geçmişiyle dünya genelinde saygın bir kurum olarak kabul edilmektedir. Inalco’da yetişen dil uzmanları Fransız hükümetinin diplomatik ve ticari ilişkilerinde aktif rol alarak bu konularda yetkililere tercümanlık hizmeti sunmuşlardır. Aynı zamanda uzman oldukları dillerin yeni nesillere öğretilmesinde öğretici pozisyonlarını korumuşlar ve ilişkide oldukları kültürlerin tanınmasında da önemli roller üstlenmişlerdir. Her ne kadar yaptıkları iş şarkiyat hizmeti olsa da Doğu kültürüne ait mirasın gün yüzüne çıkartılmasında, değerlendirilmesinde ve tasnifinde yer alarak bu kültürlere ait ögelerin korunmasında yardımcı unsur olmuşlardır. Silvestre de Sacy, Louis Bazin, Régis Blachère, Louis Massignon vb. birçok Doğu bilimci burada yetişerek hem kendi ülkelerine hem de Doğu kültürüne hizmet etmişlerdir. Ancak akademik ortamda Inalco ve benzeri kurumlar üzerine yeteri kadar çalışmanın olmadığı da bir gerçektir. Dolayısıyla bu çalışmada, Inalco’nun kuruluşu, işleyiş şekli ve faaliyet alanları tanıtıldıktan sonra bir şarkiyat kurumu olarak misyonu üzerinde durulacaktır. The generation of companions who played a key part in writing the revelation continued this responsibility in maintaining the Sunnah and translating it to some extent. Since the Sunnah is the secondary source of religion, this activity of theirs is of great importance. In this regard, the fact that some of the companions documented the Sunnah when the Prophet was still alive or after his death yielded favorable outcomes in terms of Sirah science, which attempts to properly transmit his life (...) from birth to death. In the research, the location of the written material, which was penned by the companions and identified as “codex” or “kitāb”, in the formation process of the science of Sirah will be tried to be revealed. Because the codexes, which include the majority of the narrations relating to the ghazwa and seriyyas, are among the most important sources used by Tabi'un era Sirah scholars. In the research, the principal sources of Sirah and Islamic History were taken as a basis, recent literature was scanned and academic works on the subject were benefited from. It is seen that the offspring of the companions developed the codex, who inherited from their dads or grandfathers, with the narrations they received from third parties. This study seeks to investigate the treatise of Abū al-Hasan b. Abd al-Rahman b. Muhammad al-Khatīb al-Shirbīnī al- Shāfiʻī (d. after 1028/1619) entitled Fatḥ al-Raḥīm al-Raḥmān fī tafsīr Āyat "inna Allāha yaʼmuru bi al-ʻadl wa al-iḥsān" based on the manuscript of the author. Shedding light on the translation of this unknown scholar, as it is evident from the title of the treatise that it contains the interpretation of this verse, which is well known among scholars and commentators as the most (...) comprehensive verse in the Qur’ān. In this tafsīr, Shirbīnī used many exegetical methods such as exegesis of the Qur'ān with the Qur'ān, exegesis of the Qur'ān with the Sunnah, exegesis of the Qur'ān with the sayings of the Companions, and al-tafsīr bi-al-raʼy, as well as tafsīr approaches such as linguistic tafsīr, the science of munāsabāt, and causality of nuzūl to analyze the meanings of the verse in depth. Another feature that increases the importance of this treatise is that al-Shirbīnī refers to the primary source tafsīr books together with their glosses, sometimes quoting from the commentators verbatim, and sometimes making meaning-based quotations from them, which is the most obvious indication of his exegetical ability and scholarly competence. In this work, he adopted a syncretic approach while emphasizing the meanings of the verse and followed an analytical-critical method while examining the subject. For this reason, he analyzed all the words in the verse one by one, dwelt on the meanings and interpretation of the words, and criticized their views after including the views of the commentators. Therefore, he applied the analytical exegesis method very successfully in this work. Accordingly, he analyzed the narrations related to tafsīr and mentioned the Companions' names during the narration. In particular, he analyzed the narrations from Ibn 'Abbas (d. 68/687-88) about the words al-ʻAdl and al-iḥsān, and stated that there was a dispute between the narrations about the phrase al-iḥsān. He took a scientific stance on the derivation of the word "Allah,” debated between those who accepted it and those who rejected it. He stated that the derivation of the word was not satisfactory and reliable. In the tafsīr of the words al-ʻAdl and al-iḥsān, he discussed the isnāds in Muqātil b. Sulayman’s (d.150/767) tafsīr emphasizing that he received the tafsīr of al-ʻAdl from Ibn 'Abbas and the tafsīr of al-iḥsān from 'Ali b. Abī Tālib. This approach is an important example for the isnād analyses of Muqātil b. Sulayman who was criticized for neglecting isnād chains in his tafsīr. He also criticized al-Baydāwī for being influenced by some of Zamakhsharī's sectarian and theological views. He classified the issue of kinship according to usūl, furū', and hawāshī, expanded the meaning of the verse, and insisted that the message of this verse encompasses all relatives, regardless of the degree of kinship. He was influenced by Latāʾif al-Ishārāt, al-Kashshāf, Mafātīhu al-ghayb, al-Baydawī, Hāshiya al-Jurjānī ala al-Kashshāf, and his grandfather al-Khatīb al-Shirbīnī’s (d.977/1570) al-Sirāj al-munīr. At the end of the verses 44th, 45th, and 47th of the Surat al-Māʾida, it is seen that those who do not judge by what Allah has revealed are described as unbelievers, oppressors, and fāsiqs with the general expression. Especially in verse 44th of the surah, the fact that those who do not judge by Allah's revelations are characterized as misbelievers has been a subject of debate since the early period. Many different opinions have been expressed by the mufassirs about (...) who are included in this scope, who are the addressees of the verse, whether the” kufr” here is blasphemy in the form of denying Allah and leaving the religion, or is it a different type of “kufr”. As it is understood from the information in the sources regarding the asbāb al-nuzūl of these verses were revealed as the Jews destroyed the provisions set by Allah in the Torah, changed them with various ways, and discriminated between people in various ways and applied them. With the relevant verses in Sūrah al-Māʾida, all these injustices, lawlessness, and unfairness were made away and the Jews who committed them were strongly criticized. In this regard, it is seen that some commentators have devoted themselves to the reason for the verdict of the relevant verses and interpreted the characterizations in the verse as infidels, cruel, and fāsiqs as covering only the Jews who committed these acts. However, even if the information about the contents of the relevant verses shows that these verses are about the Jews, this does not mean that the scope of the verse should be limited to them. Because both the universality of the messages of the Qur'an in general and the fact that the address in the verses came in a public way do not allow these provisions to be allocated only to a certain group. In addition, according to the rules of istinbat, the fact that the reason for making a religious provision is specific does not prevent the generalization of it. When considered within the framework of the principles we have explained, it becomes clear that narrowing down the provisions of the verses by allocating them only to a certain group is not a correct approach. In this article, it is aimed to draw attention to the richness of meaning that emerges when the relevant verses are evaluated in terms of the types of indications in the fiqh method. When the verses within our subject are evaluated in terms of the types of indications, it is seen that these verses indicate that the implementation of a provision in force cannot be avoided. In the relevant verses, it's concluded that important principles and rules of law such as the realization of justice, the rule of law, equality before the law, no one's being privileged in the sight of the law, the powers of the head of state are limited, that there is no place for ijtihad where Allah's clear judgment exists. Religion, environment, tradition, needs, and character determine the framework of people's eating habits. In this context, a special area is reserved for nutrition in the Qur'an. One of the prominent words in the relevant field is “rizq,” referring to things that Allah gives to all creatures for their own benefit. Broadly, children, spouse, action, knowledge, and wisdom can also be evaluated in this context. This study aims to reach detailed data on the subject by examining the verses where the word (...) rizq is mentioned in Surah al-Baqara in terms of language and rhetoric. In every language, but especially in the Arabic language, the words that make up the sentences, the forms of the words, the syntax of the sentence, the forms of expression, and the style are important while determining the meaning. First, the comparison method was applied in the determination of the eloquence subtleties that were taken as a basis in the study. By this method, we compared verses, sentences, and words with other related verses and possible/fictional sentences in different linguistic dimensions; determined the differences between them, and tested the results by applying them to the relevant text. Considering every linguistic structure in the Qur'anic style and investigating its meaning is essential for understanding the Qur'an. In such a reading, the presence as well as the absence of language elements should be taken into consideration and used effectively in determining the meaning. The words used in the Qur'an are fundamental because their presence or absence, the structure of words that they are used together, and the whole text constitute an important and different aspect of the conveyed message. In this paper, ten verses where the word rizq is mentioned in Surah al-Baqara are examined within the framework of the study method. Their application provides examples to a certain extent for the understanding of the specified method. Various data has been obtained about the concept of rizq as reflected in general social life. As rizq, the foods must be healthy and tasty as well as halal in terms of their ingredients and acquisition. The desire for foods of human body may vary according to various factors. However, prohibitions on food are based on reasonable, scientific, or religious reasons. The moral and philosophical dimensions of the subject are always present in the background of these justifications. One of the duties assigned to human beings is to obtain rizq within the framework of the possibilities and capabilities given to them in the world and to distribute it, if any, to those they are responsible for, creatures, and other needy people. It is a requirement of faith to utilize the rizq by considering its raison for existence and to ensure that the way of acquisition is legal and ethical. Legitimate acquisition, sharing, and distribution of what is acquired is primarily related to the sense of conscience. Therefore, it is not in the nature of faith to interfere with what is given to animals, plants, and other people as rizq. From this point of view, infaq plays an important role in understanding the concept of rizq. The Qur'an strongly expresses the desire of man to be fair and generous in the sharing of rizq. (shrink)

One of the divine quotations narrated from the timeline of Qur’ānic revelation is seen as a word of Prophet Mohammad in the 30th verse of the surah of al-Furqān. It’s observed that the speaker of this verse is Prophet Mohammad and he complains to God about his tribe which neglects the Qur’ān. In the present study, semantic structure and the meaning area of the phrase “mahjūr”, which is the key word in this verse, the meaning of it in the timeline (...) of Qur’ānic revelation and the interpretations attributed to it in the following centuries are traced. Likewise by examining Qur’ānic exegesis chronologically and investigating the interpretations of the exegetes on the relevant verse, it’s tried to see the semantic breaking points, changes and transformations regarding this verse in the historical process. Finally, the approaches of the exegetes who interpreted this verse in terms of the method of maqāsidī tafsir or the principle of teleological interpretation are determined. The approaches detected in this respect are first explained in a descriptive style, and then they’re evaluated in an analytical point of view. The findings and conclusions we reached in this study are as follows: As stated by the majority of exegetes, especially Qatāda, al-Zamakhsharī, Ibn Atiyya, Fakhr al-Dīn al-Rāzī and al-Sa‘ālibī, the aforementioned verse belongs to the Prophet Mohammed in terms of both wording and meaning. It hasn’t been determined that there’s a conflict about the pertaining of this word to him. According to this hadith quoted in surah al-Furqān, the Qurayshi polytheists made unwarranted objections to the Prophet and the divine instructions that he brought, his heart was narrowed in the face of their attitude towards the Qur’ān, and for these reasons he complained about his tribe to God. It can be said that this meaning seen in Mecca in the tenth year of his prophethood, namely, insulting the Qur’ān, abandoning it, and denying the themes in it, also includes Muslims after the revelation period. Accordingly, it can be thought that the aspect and situation of not acting on the provisions of the Qur’ān and not thinking about its verses are also valid for the interlocutors of the next period. In this direction, when we look at the history of tafsir, it has been determined that the exegetes who interpreted this verse in terms of teleological interpretation asserted different approaches. It was seen that al-Zamakhsharī, al-Rāzī, Abū al-Barakāt al-Nasafī, al-Bikā‘ī, Kamālpasazāde, Sayhzāda and Ibn ʻĀshūr interpreted this complaint of the Prophet by associating it with the coming of punishment. Therefore, in compliance with them, this verse aimed to threaten all the interlocutors, especially the Quraysh. On the other hand, it has recognized that Ibn al-Qayyim al-Jawziyah, Ibn Kathir, Bursavī and Sayyid Qutb evaluated this verse in the context of the types and ways to abandon the Qur’ān. Thus, they interpreted the relevant verse in terms of maqāsidī tafsir in a way that would cover both the first addressees of Qur’ānic revelation and other interlocutors in the following periods. In a nutshell, it can be considered that not endeavoring to understand and interpret the Qur’ān, or keeping it away from family and social life, law, understanding of earning and spending, not referring to it in such matters, or giving up living a life pursuant to it, are some of the routes and sorts of abandonment of it for Muslims. Repetitions (takrārs), which in the dictionary means ‘the repetition of something one after the other and its renewal in terms of wording and meaning’, are one of the most basic stylistic, address and textual structure features of the Qur’ān and at the same time one of the structural problems that have troubled the commentators. Repetitive nouns, verbs and letters in many verses, as well as sentences and phrases that sound like rhymes are of this kind. Although some of the benefits (...) of repetitions in the Qur’ān have been described in our tradition, it has also been stated by some that this is tiresome for a good and faṣīh word, far from any benefit, one of the disasters and defects of words that do not correspond to a mūciz word. At the same time, it has also been suggested that this is one of the things that indicate the corruption and weakness of the Qur’ānic naẓm and the existence of confusion in its naẓm. For this reason, literary scholars, linguists and commentators have considered the absence of repetition in phrases as one of the conditions of its feṣāhat (eloquence). In addition to all these, some in our tradition have treated these repetitive expressions not as a problem, but as a divine, transcendental style, and have sought a wisdom, a literary wit and a secret related to meaning. On the contrary, some have argued that the Qur’ān was revealed in the patterns of language use of the Arabs of that period, that the divine meaning and message was formed according to the speech patterns and styles of their words, advice and addresses, that the similarities of the patterns repeated in the Qur’ān were also found in their poetry, and for this reason, they associated the repetitions with the customs and habits of language use and literary tastes of the Arabs of the Hijāz region in daily speech and types of literature. Therefore, as some scholars in our tradition have argued, are these repetitions really a defect of expression, an artistic beauty? or structures that the Arabs of the nuzūl period did not know, were not familiar with, and did not hear, and that contain various subtleties of meaning? or on the contrary, are these expression patterns that were present and well-known in daily speech patterns and uses, in the literary genres of the Arabs of that day, and that were formed and manifested within the framework of their linguistic customs and traditions and literary tastes? İn this article, within the framework of these questions and problems, the relationship of the repetitions in the Qur’ān with the language usage customs, literary tastes, and linguistic cultural anthropological structures of the Arabs of the period of its revelation is examined. Therefore, as a result of this research, which is thought to be different from the existing academic studies, original and authentic, and the literature review method is used, ıt is clearly understood that the repetitions in the Qur’ān are ‘expressive structures related to the literary tastes, linguistic customs and traditions of the Arabs of the nuzūl period’ in terms of address/textual structure. In history, many conflicts have occurred in understanding and interpretation of the verses of the Qur'an. When details come up and when the opinions about the content of the subject are put forward, more conflicts occur in the interpretation of a verse even when it seems to be clear a first glance. Facts such as to whom the verse addresses, who is meant by the verse, in which time the verse has been descended and the situations revealed by the verse, (...) whether it has the same validity for everyone causes the deepening of the difference. While these conflicts sometimes bring diversity in interpretation, sometimes there may be opinions that cannot be reconciled with each other, which are quite disconnected from each other and reject each other radically. In the interpretation of the verse “There is None of You Who Will Not Pass Over It”, many different views have been put forward about who is meant in the verse, what the nature of the entry into hell is and who is within the scope of this verse. In the integrity of the Qur'an, the commentators have resorted to some evidence to solve the issue of how to locate the interpretation of this verse. Some said that this verse was only directed towards the disbelievers. Some have said that this verse is covering everyone, but the entry of believers to hell is a temporary entry and does not have the purpose of punishment. This study aims to reveal the conflicts that have arisen about the interpretation of the verse “There is None of You Who Will Not Pass Over It” (Wa In Minkum İllā Wāriduhā) and to evaluate these conflicts in the context of the semantic analysis of the verb w-r-d. Therefore, first of all, the etymological structure of the verb w-r-d was examined and the dictionary meaning of the word was revealed. Then, in order to determine the meaning of this word before the revelation, the meanings of this verb root in the poems of Jahiliyyah were tried to be determined. Then, the places where this verb stem is used in the Qurʾān are examined and the meanings in the contexts are pointed out. As the next step, the disagreements that have come up to date regarding the interpretation of the verse “There is None of You Who Will Not Pass Over” have been put forward. These conflicts have been addressed by frequently applying to the classical and modern tafsīr studies written until today, starting from the tafsir narrations from the first interlocutors of the Qurʾān. Further, these conflicts have been tried to be presented by classifying them within themselves. Subsequently, it has been tried to contribute to the interpretation of the verse by considering the data obtained from the semantic analysis of the verb w-r-d. Finally, the issue of why this verb root was preferred in this verse, which mentions that all people will go to hell without exception, has been discussed. (shrink)

Deism, which is known for denying the belief in prophethood and the hereafter while accepting the existence of a deity who is understood through reason but does not interfere with the universe while, has gained increasing popularity especially in positive scientific circles in Europe with the Enlightenment period. The development of deism in Europe has been significantly influenced by the ideas of philosophers and scientists such as Descartes, Newton, Voltaire, David Hume, and Kant. Although there is no word in Islamic (...) terminology that corresponds with the meaning of deism, terms such as Dahriyya, Barāhima, ilhad and heresy have been used to refer to different types of denial, including deism and atheism. However, it can be said that “Dahriyyah” is closer to atheism in meaning, while “Barāhima” is used in a more specific sense to deny prophethood. The words “ilhad” and heresy are used to express any kind of denial that rejects the principles of Islam. Parallel to deism being a subject of interest in our country and around the world, there has been a significant increase in studies conducted both in favour and against it. In this article, the rational proofs mentioned by Māturīdī regarding the existence of the hereafter, which deism rejects, have been discussed. In particular, the evidence found in the exegesis of relevant verses of the Qur’ān in Kitab al-Ta’wilat have been subject to examination. Māturīdī has emphasized the importance of providing rational proof for those who do not believe in the Qur’ān, stating that they will not accept any evidence derived from it. Māturīdī, who researched the reasons why people deny the afterlife, explained that people’s attempt to understand everything by comparing them to their own abilities is an important reason for the denial of the afterlife. According to him, people deny the afterlife because they believe that the power to resurrect the dead is beyond their own abilities and assume that their power is not enough for such an act. If they had contemplated the creation of the heavens and the earth, they would have realised that Allāh’s power is different from the power of His creatures. Furthermore, Imam Māturīdī pointed out that it would be absurd and pointless for Allāh, the Creator of the universe, to have created it solely for the purpose of its destruction. He emphasised that there must be a purpose for its creation, and that this purpose indicates the existence of the afterlife, where the actions of the created beings will be accounted for. In addition, Māturīdī, who said “If the world was eternal, it would not be possible to repay the deeds done,” emphasised the necessity of distinguishing between virtuous and evil individuals and giving everyone the reward or punishment they deserve. He acknowledged that human beings live in this world as a test, and the true consequences of their actions will be revealed in the hereafter. (shrink)

Prophethood (nubuwwah) is a divine institution that teaches the healthy progression of relations between Allah and humans, as well as between humans and the universe. However, from another perspective, it is also considered a human institution. Some opponents of religion, lacking strong evidence to challenge the existence of Allah, direct their objections towards prophethood, which is seen as a manifestation of Allah’s attribute of speech (kalām). To counter the rejection of prophethood, scholars of theology (kalām), hadith, and Prophetic biography (sīrah) (...) have compiled a body of literature known as Dalāʾil al-nubuwwah (Proofs of Prophethood). Their aim has been to collect proofs supporting prophethood as a response to these refutations and to dispel doubts regarding it. All extraordinary events occurring from before the birth until the death of Prophet Muhammad are considered evidence.During the fifth century, a notable figure in this tradition was the Shāfiʿī scholar al-Māwardī, who defended prophethood in his book Aʿlām al-nubuwwah (The Signs of Prophethood). Aʿlām al-nubuwwah has inspired subsequent works in this field due to its clarity and robust proofs. It became known by both names, Aʿlām al-nubuwwah and Dalāʾil al-nubuwwah, as it encompassed methods of narration and debate. Within his work, al-Māwardī mentions figures like Barāhimah, Dahriyyah, and certain philosophers as representatives of the idea rejecting prophethood. According to him, Barāhimah, of Indian origin is a sect that denies prophethood despite accepting the unity of Allah. Dahriyyah is a denialist sect attributing eternity to the universe and creativity to nature. Al-Māwardī considers these philosophers as infidels due to their comments on prophethood rather than outright denial. The basis of these movements' idea of denying prophethood lies in their efforts to portray reason (ʿaql) as an alternative to revelation (waḥy). Jews and Christians, on the other hand, are portrayed as groups that accept the concept of prophethood, however they reject Muḥammad’s. prophecy. Their objection stems from the fear of their religions being superseded. Al-Māwardī counters those rejecting prophethood by addressing the public interest (maṣlaḥah) of humans, the necessity of prophets, and the role of miracles. He illustrates that prophet charged with the duty of prophethood proves it through spectacular events orchestrated by Allah but carried out through his own hand. The prophet serves the public interest by conveying matters beyond human intellect and presenting them in a comprehensible manner, thereby ensuring the worldly and eternal felicity of humanity. Furthermore, he provides evidence for the Prophet Muḥammad’s prophethood through his moral character, prophetic biography, and accounts of miracles. The biography of Prophet Muhammad’s begins before his birth, and the method of proof is used to demonstrate his prophethood. In essence, al-Māwardī’s method of proving prophethood in Aʿlām al-nubuwwah can be seen as a synthesis of the approaches used by scholars of theology and hadith. One prominent figure in this tradition during the fifth century was the Shafi'i scholar al-Māwardī who defended prophethood through his book " ʿA'lām al-Nubuwwa" (The Signs of Prophethood). In his work, al-Māwardī mentions figures like Barahima, Dahriyya, and certain philosophers as representatives of the idea rejecting prophethood. While the Jews and Christians accept the concept of prophethood, they reject the prophecy of Muhammad (P.B.U.H). These groups attempt to present logic as an alternative to divine revelation (Wahy), as their objection stems from their concern that their religions may be abrogated. Al-Māwardī responds to those who reject the institution of prophethood by addressing the public interest (maslaha) of humans, the necessity of prophets, and the role of miracles. He also provides evidence for Muhammad's (P.B.U.H) prophethood through his moral character, prophetic biography, and accounts of miracles. In short, al-Māwardī's method of proving prophethood in "A'lām al-Nubuwwa " can be seen as a synthesis of the approaches used by scholars of theology (Kalam) and hadith. (shrink)

The Islamic thought has experienced many ruptures in history. One of them is the Mihna period. The main argument of the mihna period, which started during the reign of the Abbasid Khalifa Me'mun, was the issue of the khalq al-Qur'an. The leading figures of the period were dictated to accept the idea that the Qur'an was created. Those who took an opposing stance were oppressed and tortured. In this period, people like Ahmed b. Hanbal, who did not bow to oppresion, (...) were made heroic by the people. This time, the reverse Mihna period started and those who spoke about the people of the Qur'an were criticized. Many of the muhaddith considered the approach to the issue of the khalq al-Qur'an as a bid'ah. This situation has created a field of criticism for people and segments who do not like each other. For this reason, unfair perceptions have been created about some people and their authorities in the society have been targeted with unfounded claims. Therefore, it is important to consider the approaches of Islamic scholars or sects to the subject objectively and to evaluate them in this context. In this study, the approaches of Dâwûd az-Zâhirî (d. 270/884), the founder of the Zâhirî sect, who were negatively affected by the situation in question, and other Zâhirî scholars to 'khalq al-Qur'an' were examined. In addition to the perception made about them, it is aimed to determine the accuracy of the discourses attributed to them. In this context, first of all, the views attributed to them are (i) The Qur'an in our hands, which consists of paper and ink, is not created, whereas the Qur'an in the preserved tablet is not created. (ii) The Qur'an is muhdes (created). (iii) The Qur'an is muhdes, and it is a creature in terms of its pronunciation. (iv) When the Qur'an is recited, the pronunciation that occurs as a result of the movements made by the servant to extract the letters has been classified as creature. These discourses attributed to them were compared with the information found in the works of Zâhirî scholars and it was determined whether they were consistent or not. As a result of the researches, Dâwûd az-Zâhirî, who was in Nishapur during the years when the mihna process continued, expressed some discourses about the creation of the Qur'an; however, with the end of the mihna, it was concluded that he gave up his discourses in question. Ibn Abi Asim (d. 287/900), Ibn Niftawayh (d. 323/935), Ibn Hazm (d. 456/1064), and Ibn al-Kaysarani (d. 507/1113), who are among the apparent scholars, have openly stated that the Qur'an is not a creature and they also blaspheme those who claim otherwise. In addition, it has been observed that the perception made independently of the correctness or falsity of the discourses attributed to them negatively affects the Zâhirî scholars in many ways. For example, it is because of this that Zâhirî scholars who are exposed to such perceptions lose value both in the eyes of the public and in the scientific assemblies. (shrink)

In the formation of the acquis of the science of fiqh, many scientific figures have been associated with the methods of the Imams of the sect and their views, which are passed on to the next generations. In the history of the Ḥanafī mad̲h̲hab, there are many scholars whose works, views or just their names have survived. The views of the scholars who are at the forefront of this work can be accessed through their works. The opinions of some scholars (...) who did not have works, or whose works have not survived, can be found in the jurisprudential corpus of other scholars. Unfortunately, there are many scholars whose works and opinions have not survived, and only their names are mentioned. This study focuses on the Ḥanafī jurist al-Baqqālī (d. 452/1060), whose scholarly personality, position in jurisprudence and works have not survived to the present day, although his name is mentioned in fiqh literature. The article analyses various sources and evidence for the identification of al-Baqqālī. The main argument of the article was clarified by examining fiqh books, which are among the authoritative sources of the Ḥanafī fiqh corpus, rather than works of ṭabaḳat, and by scanning digital resources. The determination and presentation of the scholarly personality of al-Baqqālī and his jurisprudential views are the distinctive feature of this article. Baqqālī was recognised as an influential jurist within the Ḥanafī fiqh tradition and was considered one of the mashāʼịḵẖ (eminent jurists). However, detailed information about him could not be found. However, considering the available evidence, it is proven that al-Baqqālī, who stands out with the attribution of al-Baqqālī, is not al-Baqqālī whose views are consulted in the Ḥanafī mad̲h̲hab and among the possibilities that arise, the views that predominate in the identification of al-Baqqālī's identity are given. For this reason, it is emphasised that Baqqālī is a figure that requires further research and study. It is emphasised that this article can contribute to the understanding of the Ḥanafī fiqh tradition. Baqqālī's jurisprudential views on some matters of worship and transaction reflect important debates. Although al-Baqqālī adhered to the basic principles of the Ḥanafī mad̲h̲hab, he occasionally developed original ijtihād against the general views of the imams or the mad̲h̲hab. Baqqālī's original jurisprudence and jurisprudential views occupy an important place in the sect's literature. He was particularly influential in matters of fatwa and left his views to later jurists. Such a study aims to solve a scholarly problem in the fields of the history of science and the history of fiqh. Clarifying the identities and specialisms of those involved can help to ensure historical and scientific clarity. The purpose of this article is to contribute to the accumulation of historical and scientific knowledge by seeking to learn more about this issue and to reduce uncertainties. (shrink)

A human who open their eyes to life finds themselves within a religious tradition and culture. They encounter religious objects and places, meets religious people and live in communication with them. They learn about religion from their family and their surroundings; they see people who perform their religious worship, and from time to time, they themselves participate in these worships. They ask questions, do research, and turn to the use of religious words and concepts. Childhood period has a significant impact (...) on the formation of religious belief, attitudes and behaviours in adulthood, in other words, on the construction of religious identity. The study examined the origins of individual and collective religious identity, religious experiences from childhood to adulthood and cultural contexts. Thus, it was investigated that how participants constructed their religious identities by making sense of the reference frameworks that they acquired from religious narratives and traditions. In this context, the factors that shape and define the construction of religious identity have been analysed in two dimensions, theoretical and field research. 60 participants aged 25 to 75 living in Kahramanmaraş were interviewed in between 2021 and 2022. The study analysed findings about how adult religious individuals build their religious identities using phenomenological patterns from qualitative data collection methods. In the study, the participants were selected with the purposeful sampling method identified with the phenomenological pattern and the study conducted 40-160 minutes of face-to-face in-depth interviews with semi- structured questions prepared separately for 5 main and 13 sub-categories. The data obtained was analysed and categorised using the MAXQDA 12 package program. At this point in our research, the question of what are the factors that influence the formation and maintenance of a person’s religious identity is sought in the framework of the research findings. According to the findings obtained as a result of the study which is based on the basic approaches of role theory it has been observed that the family factor is prominent in building an individual’s religious identity. In addition to the influence of parents on family members in shaping religious identity, it has been observed that some participants are influenced by extended family members such as grandparents. On the other hand, it has been found that schools and courses attended under the referral of the family or the society, the religious officials and religious groups met, and media programmes followed are factors that influence the building of the individual’s religious identity after the family. It has been determined that religious texts and folkloric elements provide stereotyped roles in making choices such as the style of clothing eating and drinking, which are symbolically reflected in the individual’s life, in the implementation of religious orders and moral principles, in short, the construction of religious identity. This study aimes to examine the basic codes of Manichaeism thought and to discuss whether the thoughts of Manichaeism followers disappeared after they were erased from the earth. In our research, religious phenomenology and comparative method were used in traces of the uninterrupted tradition of wisdom. In the study, an effort has been made to capture the traces of Manichaeism in later religions and thoughts by revealing the framework of the thought mechanism of Manichaeism, and thus, to draw attention to (...) the timeless flow and theme of the wisdom tradition. Some examples from the pre-Islamic and post-Islamic periods are presented in order to prove the thesis that Manichaeism continues its existence with its messages. In this discussion, I addressed that deep gnostic thoughts were not understood by the masses focused on reward and punishment, nor were they appreciated by the exoteric clergy. The study pointed out that esoteric thoughts were eliminated with the support of governments that derive their power from the masses. Afterwards, gnostic thoughts such as Manichaeism and Illuminationism were evaluated as the internal dynamics of the literature of hostility to matter, which disregards worldly life and even leads to extinction, preparing for their own end. The following common theme is underlined in the relationship established between Manichaeism and later gnostic or gnostic thoughts: The human soul, which is a piece of light, has fallen from the world of lights located in a supreme place to the lower material world and material human body, which has a demonic origin, and has fallen into forgetfulness, fainting, amnesia or heedlessness there, and has been awakened by gnostic messages or revelations sent by savior messengers, after this awakening, he embarked on a spiritual journey with eschatic practices and asceticism, and eventually reunited with his homeland and united with the source of light. While the Manichaean system of thought also has important commonalities with the spiritual gnosis, which became more evident in the post-Islamic periods and stands out with its opposition to matter, it broke away from the Zoroastrian thought, which sees matter as the perfect form of creation, and it also was noticed that it was the opposite the existential gnosis system of Islam, which sees matter as a manifestation and mirror of the creator. As a result, the study suggested that Manichaeism was nourished by previous religious traditions such as Zoroastrianism, Buddhism, and Christianity, proudly expressed this unity and closeness as an heir of eternal wisdom, and continued its existence through later religious and intellectual traditions, including Islam. Again, although it has no followers today, I concluded that Manichaeism continues to exist within the later religious thoughts with its gnostic messages, continues its effects under the guise of various mystical groups until today, and in the final analysis, the spirit and theme of eternal wisdom beyond time and space can continue to exist even if its followers disappear. The theoretical system of Ottoman music was developed through the works of Safi al-Din al-Urmawī (d. 693/1294) and ʿAbd al-Qādir Marāgī (d. 838/1435). Considering the first period, although the 24-tone sound system was not developed in theory, it is clear that it was used in practice. However, in a theoretical sense, the 17 sound system initiated by al-Urmawī continued to be used until the 20th century. In this century, the Turkish theoretical musical system evolved into a different point with the (...) efforts of Raūf Yektā (d. 1935). Here we have an unequal 24-track sound system. The first written traces of the 24-tone sound system can be seen in the work of La Borde (d. 1208/1794). Later, Muhammad al-‘Attār (d. 1243/1828) and his student Mīkhāʾīl Mishāqah (d. 1305/1888) found fame with their 24-tone sound system. Mishāqah's work named Riṣālah al-Shihābiyyah fī al-ṣināʻah al-mūsīqiyyah, which also includes this system, has become an important cornerstone in the shaping of modern Arabic music. Raūf Yektā, who noticed this system through a newspaper article, determined that this note system, which is divided into 24 equal parts, provides great convenience in Turkish music, especially in naming intermediate sounds. This determination of Yekta is largely similar to the note names in Mishāqah's system, despite some differences. The main difference between this system that Yektā introduced to Turkish music and Mishāqah's system is that Yektā prefers unequal sounds. In this study, information about who first introduced the 24-tone sound system is included. However, no clear data on this subject has been found. From the perspective of Turkish music, this systematic breakthrough succeeded by Yektā - although not put forward by Yektā - enabled him to lay the foundations of today's theory with the Arel-Ezgi-Uzdilek trio. In this research, it has been determined that some of the concepts included in Mishāqah's work are the same in terms of content with the concepts in Turkish music. The focus of this study is the work named Riṣālah al-Shihābiyyah fī al-ṣināʻah al-mūsīqiyyah, written by Mīkhāʾīl Mishāqah, which Murat Bardakcı clearly stated in an article and which we think Raūf Yektā used in creating the sound system of Turkish music. The aim of the article is to reach the first traces of the 24-tone sound system and to reveal its connection with Turkish music. In the literature study, it is founded that no detailed study has been conducted on both Mīkhāʾīl Mishāqah and where the traces of the 24-track sound system can be traced. In this respect, seeking answers to these questions constitutes the originality of the article. This research aims, first of all, to establish that Abû Hanîfa's (d. 150/767) positive view on the issue of performing wudû’ with nabîdh of date is correct, and then to reveal Abû Hanîfa's dalîls on this subject. The issue of wudû’ with nabîdh of date is controversial among early Hanafî jurists, and the jurist who expressed a positive opinion on this issue is Abû Hanîfa, the founding imam of the madhhab. The opinion that wudû’ can be performed with nabîdh of (...) date is the strong opinion of Abû Hanîfa mentioned in zâhir al-riwâya. The riwâya reported by Nûh bin Abi Maryam (d. 173/789) stating that Abû Hanîfa reneged on this view is not strong enough to oppose the view in zâhir al-riwâya. For this reason, it is not a correct approach to ignore the view in zâhir al-riwâya based on this riwâya. As a matter of fact, Abû Hanîfa's view of zâhir al-riwâya is conveyed in many of the classical Hanafî texts such as Mukhtasar al-Karkhi and Mukhtasar al-Tahâwî. Although the majority of Hanafî jurists preferred the view of Abû Yûsuf (d. 182/798), a significant group of Hanafî jurists such as Jassâs (d. 370/981), Kâshânî (d. 587/1191) and ‘Aynî (d. 855/1451) He supports Abû Hanîfa's view. Therefore, there are two views on the issue in Hanafî fıqh. In the literature, the dalîls of Abû Hanîfa's view is not available as a whole in a single source, but is scattered in many Hanafî fiqh sources. The Hanafî jurist Jassâs is the one who deals with the mentioned dalîls in the most comprehensive way in his many works. For this reason, the subject was examined by focusing on Jassâs's dalîls. Jassâs' istidlâls regarding the issue of wudû’ with nabîdh of date also mean defending Abû Hanîfa against other Hanafî jurists such as Abu Yusuf and Imâm Muhammad (d. 189/805). Jassâs' insistent attitude on this issue and his passionate counter-answers prove how much he deserves the title of defense. For the relevant determination, Hanafî fiqh classics are centered. Because the jurists who argue that wudû’ can be made with the nabîdh of date are among the Hanafî jurists. Then, the positive and negative approaches of the jurists about the nabîdh of date are given. Starting from the early Hanafî jurists, the views of the sahâbîs, the tâbi'ûn and many later jurists on the subject are included. The approach of the four madhhabs of fiqh is also examined in this section. Then, the istidlâls of Jassâs, which is the main subject of the research, were emphasized. It is seen that Jassâs' istidlâls have three main pillars: âya, hadîth and idjma. As a âya, the 6th âya of the sûra of Mâida, as a hadîth, the hadîth of ‘Abd Allâh bin Mas'ûd (r.a.) and as a idjma, the the sahâbîs idjma tries to showas references. The most controversial dalîl is undoubtedly the hadiths of Ibn Mas'ud (r.a.). Jassâs opposes those who claim that the hadîth is da‘îf and discusses the hadîth with its detailed tarîks and argues that this hadîth is sahîh. (shrink)

Muwāsāt encompasses the moral duty to provide aid to those in need, prioritising those closest to us while sharing what resources we can spare. However, should a person's legally protected values be at risk, assistance and solidarity become mandatory obligations. Islamic law recognises this social duty as fard al-kifāya, with muwāsāt as the justification for this sufficient obligation. On the other hand, muwāsāt is also included in the legal justification of in-kind obligations such as zakat and alimony. Muwāsāt actually has (...) a broad conceptual content that includes each individual in the society helping each other, sharing, and sharing what they have when necessary. The aim of muwāsāt is to keep social sensitivity towards those in need alive. Muwāsāt constitutes the wisdom of meeting the needs of the other party by sharing the resources available to each individual in the society when the legal values that Islam aims to protect are in danger. In this context, this study aims to evaluate the rights of those in need over those who have the means to meet their needs by considering the proposal in the context of the provisions. To prioritize the legal values of Islam and safeguard the sanctity of life, as well as protect bodily integrity and uphold the right to privacy, the principle of muwāsāt necessitates that all Muslims must uphold these responsibilities towards themselves, each other and the state. This study aims to investigate muwāsāt, which defines the duty to provide assistance to any individual who is cognisant of their plight, within their capacity, when their legal rights that must be safeguarded are threatened, in the framework of social accountability. In this context, it can be said that muwāsāt has a direct connection with the proposed obligations in Islamic law. Muwāsāt is included in the justification of fard al-kifāya obligations. However, the fact that the obligation of zakat, the obligation of fidya, and the responsibility of alimony are included in the legal justification of meeting the needs of the needy by those who are not dependent on anyone, shows us that muwāsāt is the basis of obligations involving cooperation. Similarly, the legal reason for banning interest is that it destroys the balance in society. In particular, the basis for the state to impose an upper limit on exorbitant prices is based on the principle that every individual has an equal right to meet basic needs. In other words, determining the profit margin in the prices of basic needs is a requirement of muwāsāt. The definition of the state’s obligation, along with individual responsibility in muwāsāt, aims to ensure that there is no individual in society whose basic needs are not met. Consequently, muwāsāt has an aspect that includes social responsibility and legal liability along with conscientious responsibility. This shows that Islam adopts the protection of life as the highest legal value. Muwāsāt is not limited to meeting basic needs, but also includes giving this support to a person when he needs moral support, sharing his pain by standing next to him, feeling him and internalizing his pain. For this reason, muwāsāt actually defines the moral stance that a Muslim should have. Based on this moral stance, it is safe to say that the most fundamental concern of Islam is to protect the material and spiritual integrity and human existence. This study aims to express, in the context of Islamic law, that the main purpose of Islam is to protect human beings in their material and spiritual integrity by examining and evaluating muwāsāt in its broad scope. The rapid change in the world after the Enlightenment not only brought about revolutionary scientific and technological innovations, but also opened the door to important transformations in the context of thought. Especially with the wind created by the French Revolution, some concepts such as equality, fraternity, and justice, which were already in circulation before, came to the fore even more. One of the concepts that was magnified in this process was freedom. The concept manifested itself in philosophy as an understanding (...) of free will against the idea of determinism, and in politics as independence against oppressive governments. Since the day it was addressed as an independent topic, it has attracted attention with its different types and aspects, including freedom of the press, freedom of thought, freedom of expression, freedom of religion and conscience. We see that the intellectual adventure of the Western world in the last two centuries has been shaped around these concepts. The libertarian attitude, which at first manifested itself as a rebellion against religious and secular authorities, was later driven to extremes that saw itself as independent from all moral and social norms. These debates were inevitably reflected in the field of theology, and topics such as the position of the will of man against God’s will, fate and the problem of evil were reconsidered according to contemporary claims and objections. The atheistic tendencies that emerged in the Western world claimed that all religions deprive man of the possibility of being an active subject on earth and that a person who believes that all his/her actions are known and determined cannot be truly free. This point is actually one of several important issues that contemporary atheism raises against theism. These debates have also reached the Islamic world and the issue continued to be addressed with similar arguments. At its core, each of these claims rests on the assumption that Islam's conception of the human being leaves no room for individual freedom. Although the problem has different aspects such as fate and theodicy, one of the most striking aspects of the problem is the question of whether man has the right to reject Islam as well as the right to enter Islam by one’s own free will. It is important to answer this question. Because some practices from the early period of Islamic history and the assumptions that apostates should be killed according to certain conditions, which are accepted as an established jurisprudence in Islamic law, have provided important opportunities for anti-Islamic ideas and ideologies. This article shows how the issue has been dealt with in the classical literature, while at the same time suggesting solutions on how to approach the phenomenon of conversion today. In addition, the study will show that the issue is dealt with in the context of public security in the fiqh literature, and therefore, the current cases of conversion or apostasy do not fully correspond to the discussions in the classical period. One of the prevalent inference methods the mutakallimūn uses is qiyās al-ghaib ‘ala al-shahid (analogy from the visible world to the invisible world). Mu‘tazila, who accepts this method as an absolute criterion in the divine attributes, rejects the possibility of difference between shahid and ghaib about the reality of attributes. By rejecting the concept of kalām nafsī adopted by Ahl al-Sunnah, they mention the divine speech in the category of actual attributes and claim that kalāmullāh (God’s speech), like human speech, (...) is an accident consisting of words and sounds. Mu‘tazila, who defines mutakallim as the agent of kalām, claims that God is also the agent of the word. In this regard, Mu‘tazila, who defends the origin of the kalāmullāh and the createdness of the Qur’ān, focuses on the explanation of the nature of the kalām at the beginning of these theological subjects. As an extension of the issue of whether the ḥikāyah and maḥkī are the same or not, which is the subject of discussion in the context of the possibility of creating something similar to the Qur’ān, Mu‘tazila, who disagree on whether kalām (word) is a kind of sound (ṣawt) or not, examine the problem of the nature of the word by expanding it to include sounds. Although they agree that sounds are accidents created by humans through tawlīd, they propound different theories about the physical formation of sound and kalām. These theories are differentiated according to discussions about the essential factors for the formation of sounds. Some scholars claim that i‘timād generates sounds, and the substrate (maḥall) is enough to form the sounds. In contrast, others claim the necessity of a specific structure (binya), movement (ḥaraka), and air added to the substrate. In this regard, this study will deal with the effect of these factors mentioned above to the formation of the sounds and the physical examples which every group mentioned to prove its opinions rightfulness. The most detailed explanations about this topic are seen in the works of Baṣrian Mu‘tazila. Therefore, this study will examine the opinions about the production of sounds, which argued around metaphysical issues in the context of the createdness of the Qur’ān and the attribute of kalām, which are submitted by Abū ‘Alī al-Jubbā'ī (d. 303/916), Abū Hāshim al-Jubbā'ī (d. 321/933), and their followers Qāḍī ‘Abd al-Jabbār (d. 415/1025), Abū Rashīd al-Nīsābūrī (d. first half of the 5./11. century), and Ibn Mattawayh (d. first half of the 5./11. century), the representatives of Baṣrian Mu‘tazila, who adopt atomic universe understanding. The study aimed to form an opinion about the theologians’ way of discussing a particular physical phenomenon to constitute a basis for solving metaphysical problems. To clarify the problem, first, it will deal with the essence of sounds in the Baṣrian Mu‘tazilites tradition, and then it will tackle the discussions about the formation of the sounds. (shrink)

Discussions on the concept of Marifatullah as the foundation of belief hold a significant place in theology. There are different opinions among schools of theology regarding whether those who do not receive divine messages must know God. The majority of scholars belonging to the Mu'tazila and Māturīdī schools, including Imam Māturīdī, state that human beings must know God. Although al-Ashʿarī accepts that the most prominent obligatory duties are the methods of reasoning that lead to marifatullah, he states that responsibility in (...) this matter is formed by transmission. However, we can say that whether the human mind is sufficient to reach the knowledge of God, the method of reasoning has reached a different dimension today from the sciences of psychology, genetics, and neurobiology. This study explored whether individuals can achieve marifatullah from a holistic perspective. Whether human beings can be held responsible for this issue has been evaluated through the sciences of psychology, genetics, and neurobiology, and the opinions of schools of theology on this issue have been criticized. When we think in terms of Marifatullah, we can say that man’s psychological sense of obligation to adapt to society leaves him intellectually under the influence of society. In terms of genetic determinism, human personality, behavior, and intellectual adventure are completely determined by genes. Therefore, it is impossible for men to reach marifatullah in the context of their mental abilities. From an epigenetic perspective, we see that human thought structure, behavior, and personality are formed as a result of interactions with the environment. Serious hesitation arises in this idea in terms of intellect being a source of responsibility. Humans are genetically influenced by the environment and society, and they have a suitable nature for this, revealing that their genetic structure is open to environmental influences. In terms of brain plasticity, factors such as the society, environment, and family in which people live can change their brains and enable them to live accordingly. Although life adventures appear to be within the framework of social harmony, there must also be intellectual and religious harmony within social harmony. This reinforces the idea that individuals tend to align more with the thoughts and beliefs instilled by culture given the adaptable nature of the human brain influenced by cultural factors. When the views of the schools of theology are considered considering these evaluations, it becomes clear that the Mu'tazilites and Māturīdīs' belief that the source of the wujūb of marifatullah is intellect is at a point that needs to be reconsidered in terms of human biology and psychology. Although the Asharites emphasize human beings attaining knowledge of God through intellect, their focus on prophethood indicates that a revelation offer appears more accurate concerning human nature in the context of Marifatullah. In Averroes’s epistemology, knowledge is universal, but it is always singular in terms of the known. Averroes believes that there is no need for an activity, even in the sense that used by those who have the idea of "kumūn" rational forms being formed by other rational forms of the same kind, or for a power such as in the example of polishing a mirror to reflect an image. Similarly, he argues that there are no discrete abstract forms of existing (...) things because otherwise, everyone would have to know everything. Although there are different degrees and levels, the existence of absolute metaphysical forms is subject to change and increases with the multiplication of their subjects. There are three means of knowledge: sensation, imagination, and intellect. Unlike the sensation and perception modes in animals, humans perceive the outer appearance of objects as well as their unique meanings and distinctions. Like animals, the function of sensation in humans is to mediate the self. While perception is abstract and spiritual in one sense, it is material and concrete in another. Averroes does not find it correct to link the knowledge of the contingents of the world to the eternal knowledge of God. Beacuse this implies that there is a difference in God's knowledge between the state of the world's existence and non-existence. In addition, human knowledge about contingents is deficient and changeable, whereas God's knowledge is the cause of the existence of contingents and is unchanging. Ultimately, it does not seem possible for humans to comprehend the nature of God's knowledge. It is agreed with Alexander of Aphrodisias that there should be a distinction between the active and imaginative intellects, but he differs from him in the point that the imaginative intellect disappears. According to Averroes, the active intellect in action is eternal, unlike Themistius’ view. According to Averroes, the intellect is neither a pure potentiality nor a distinct substance. That is to say, if the imaginative intellect were an actual thing, it could not perceive other things. If the intellect were absolute, everyone would know the same things. Similarly, if the intellect were absolute plurality, there would be no unity and connection between intellects. If the intellect were merely an accepting capacity, it could not perceive absence. According to Averroes, the active intellect is not a distinct intellect that gives form or governs the spheres, but rather the form and purpose of the imaginative intellect. There are two powers of this intellect: to abstract the concepts in their potential state from their matter and to make them actual and accepting them. In conclusion, it can be said that Averroes made a substance-centered philosophy regarding the possibility and reality of knowledge, and while he did not deviate from the Aristotelian line, he had to make new openings. Paradoxically, he tries to explain both the actual/abstract and potential/material aspects of the intellect that are postulated by introducing an original soul theory with the imaginative intellect. Therefore, he places importance on both a priori knowledge and sensation and imagination. (shrink)

Differentiated instruction is an approach that centers on the fact that every student is different and shapes the teaching process according to this reality. Students in the learning environment differ from each other in terms of characteristics such as prior knowledge, interest, needs, learning style, socio-cultural background, cognitive-affective-psychomotor readiness. In order for students with different characteristics to benefit from education in the best way, it is necessary to diversify education in terms of content, teaching-learning process and measurement-evaluation dimensions, taking these (...) differences into account. In this diversification, students' readiness, interest and learning profiles are taken into account as a whole. Although educational programs are prepared by taking the similarities between individuals into account in practice, teachers are expected to diversify the process by taking the individual differences of the students into account and design different learning paths for students with different characteristics. One of the areas that needs to be planned and implemented with a differentiated teaching approach within formal education is religious education. Differentiated religious teaching is to diversify religious teaching in terms of content, learning-teaching process and measurement and evaluation dimensions, taking the individual differences of students into account such as their prior religious knowledge, interest and attitudes towards religion, cultural affiliations and learning profiles. In this study, the self-efficacy perceptions of Religious Culture and Moral Knowledge (“Din Kültürü ve Ahlâk Bilgisi”, abb. DKAB in Turkish) teachers towards differentiated teaching were examined. Determining the self-efficacy perceptions of DKAB teachers regarding differentiated instruction is important in terms of providing information about their success in planning, implementing and evaluating according to differentiated instruction in the Religious Culture and Moral Knowledge course. The research sought answers to the following questions: 1. What are DKAB teachers' self-efficacy perceptions towards differentiated instruction? 2. Is there a significant relationship between DKAB teachers' self-efficacy perceptions towards differentiated instruction and teachers' gender, age, years of service, graduated higher education program and the type of school they work in? The research is a descriptive study and is of quantitative type and survey model. The population of the research consists of DKAB teachers working in primary and secondary education institutions in the 2nd semester of the 2021-2022 academic year. The sample of the research consists of 425 DKAB teachers selected from the population using the appropriate sampling method. Differentiated Instruction Self-Efficacy Scale developed by Mutlu, Öztürk and Aktekin was used to collect the data used in the research. The data collected in the study was analyzed using the SPSS 25.0 package program. According to the findings obtained in the study, DKAB teachers' self-efficacy perceptions regarding differentiated instruction are at a high level. The characteristics of DKAB teachers' age, years of service, and the type of school they work in do not have a significant effect on teachers' self-efficacy perceptions regarding differentiated instruction. There is a significant relationship between DKAB teachers' gender and the characteristics of the higher education program they graduated from and their self-efficacy perceptions. Male teachers consider themselves more competent in differentiated instruction. The self-efficacy perceptions of the teachers who graduated from the primary education DKAB Teaching program are at a higher level than the teachers who graduated from the theology (Ilahiyat) program, which is described as the faculty of theology. The subject of this study is the naḳīḍa (opposing) type of poetry competitions between the Meccan poet Ḍirār b. al-Khaṭṭāb (d. 12/633) and the Muslim poet Kaʿb b. Mālik (d. 50/670) from Medina during the Battle of Badr, when the Muslims and the polytheists confronted for the first time. The problem is the questioning of the approaches reflected in the naḳīḍa poems, which were used as a means of propaganda and psychological superiority by the Muslims and polytheists during the Battle (...) of Badr. Naḳīḍa poems, the subject of the study, are important for getting to know the two opposite understandings closely and forming an opinion about the naḳīḍa poems sung during the era of the Prophet Muhammad. Although there are some recent studies on naḳīḍa poems from the era of the Prophet, these studies lacked details and only mentioned general features. The interesting approaches and fine details reflected in the verses, such as Ḍirār b. al-Khaṭṭāb's claims aiming to distract attention and discredit the Muslims of Medina in the face of the unexpected defeat of the Meccan army at Badr that the Battle of Badr was a tribal war between the Meccans and the Medinans, makes this study prominent. On the other hand, Kaʿb b. Mālik's verses reflect the approaches bearing traces of the Islamic faith and draw attention to the fact that the battle was between faith and unbelief and the Muslims of Medina were proud of their support for the Messenger of Allah. Undoubtedly, Meccan immigrants participated in the Battle of Badr along with the Muslims of Medina. Even so, Kaʿb b. Mālik does not mention Muhājirs (immigrants) in his verses. This suggests that Kaʿb b. Mālik may have concentrated on responding to the allegations made by Ḍirār b. al-Khaṭṭāb. Document analysis, one of the qualitative method techniques, was used in the study. First, a literature review was conducted to better understand the subject, and the studies related to the field were briefly mentioned. Then, summary information about the concept and background of naḳīḍa is provided. Two call-and-response poems between the Jāhiliyyah period poet Imruʾ al-Qays (d. 545) and ʿAbīd b. al-Abraṣ (d. 555) are included as an example for the first phases of naḳīḍa poems. Then, brief information about the Meccan poet Ḍirār b. al-Khaṭṭāb and the Medinan poet Kaʿb b. Mālik are presented. After the background information, two naḳīḍa poems of both poets were examined and analyzed, and the differences in the Battle of Badr were pointed out. Concepts that are common in the eulogies of the Jāhiliyyah period, such as nobility, being a master warrior, and generosity, draw attention in Ḍirār b. al-Khaṭṭāb's verses. On the other hand, in his verses Ka'b b. Mālik uses terms and expressions brought by Islam such as the Messenger of Allah, there is no Lord but Allah, unbelievers, Hell, and hellfire. In the verses of both poets, there are clues about the commonly used battle orders and war equipment of the period. The opinions are summarised in the conclusion part of the study. (shrink)

In the field of ʿUlūm al-Qurʾān, in which the conceptual framework of the science of interpretation is drawn and the main rules used in tafsīr are discussed, independent books have been compiled since early periods. Some of these works stand out as foundational texts because they make important determinations about the nature, function, methodology, and relationship of the science of tafsīr with other Islamic sciences. The masterpiece entitled Fahm al-Qurʾān by al-Khāris al-Muhāsibī, a scholar of sufism, tafsīr, kalām, and hadīth (...) is one of these books. Al-Muḥāsibī was a writer who lived in a period when philological and Sharīʿah sciences gained a systematic structure and schools were born and developed. Muhāsib'i's multifaceted scholarly depth, the requirements of his time, and the characteristics of his work distinguish Fahm al-Qurʾān from other works in the field in terms of its problematic, content, and style. It can be said that Fahm al-Qurʾān consists of two main chapters. In the first chapter, the issues of kalām, meaning, and reason are subjected to a quiddity inquiry. In the second chapter, the linguistic aspect of kalām is emphasized and the content and style of the Qur'ān are discussed under the headings of muhkam- mutashābih, naskh and üslūb al-Qur'ān. In this work, al-Muḥāsibī suggests that before asking How we should understand the Qur'ān?, the reader should ask What exactly is being understood and what is meaning? The first of these questions includes the question Who am I? While the sources of The Sciences of the Qurʾān mostly focus on how to understand the Qurʾān at the epistemological and methodological level, in Fahm al- Qurʾān, the meaning of understanding the Qurʾān is problematized and a theory of reason and meaning that is competent with moral training is built. Thus, the conceptual inquiries of the work extend to the existential philosophy of the author. Despite these privileges, it is surprising that Fahm al-Qurʾān did not gain a prominent place among the main sources of tafsir methodology in later periods. This may be due to the theorization of a theory of meaning in which moral maturation is placed at the center. In this research, while trying to reveal the original value that Muhāsibī added to the field with Fahm al-Qurʾān, the systematic structure of the science of interpretation, its connection with other religious sciences, the relationship between speech adjective and language were made problematic and tried to be resolved in the context of the research hypothesis. In this context, it has been determined that al-Muḥāsibī's Fahm al-Qurʾān draws the conceptual framework of tafsīr methodology in relation to the authentic structure of the sharī'ah sciences at a very early period. The fact that Fahm al-Qurʾān carries important signs regarding the position of tafsīr in the hierarchy of sciences and its relationship with other sharī'ah sciences increases the value of the work in identifying the codes of the traditional paradigm. In the research, in which induction methods were used in text analysis and deduction methods were used in discourse analysis, it was determined that Fahm al-Qurʾān had a fiction that shapes the traditional paradigm and depicts the authentic structure of religious sciences. Abdullah Bosnawī is one of the representatives of the Ibn al-‘Arabī school, which has an important place in the tradition of Islamic thought as well as in the field of Sufism. He is also an Ottoman intellectual who successfully annotated the Ibn al-‘Arabī's "Fuṣūṣ al-Ḥıkam" in Turkish and Arabic for the first time. Most of the treatises that Bosnawī wrote in the field of tafsir and mysticism are in manuscript and are waiting to be introduced to the world of science. (...) His treatise, which contains original interpretations, in which he interprets the story of Dhu’l-Qarnayn according to the theory of waḥdat al-wujūd, which is influential in Islamic thought, is one of them. In the study, the method of examining, comparing and evaluating the tafsir and mysticism literature was applied to the extent of its relevance to the subject. After giving information about the author, the literal and isharī interpretations on the story of Dhu’l-Qarnayn were examined and compared with the comments of Bosnevi. The interpretation method of the author in the treatise is researched, evaluated and introduced. The position of the interpretations of the author in the tradition of isharī tafsir has been tried to be revealed within the framework of the historical stages of Sufism. The content of the treatise has been introduced under the appropriate headings for the handling of the subject. It has been seen that the author, who is observed to use tafsir methods such as explaining the verse by verse, considering the siyâk-sibâk relationship, does not go into too much detail, although he uses classical tafsirs in his literal interpretations. It has been understood that in his isharī tafsirs, he adapted to the tradition of ṣūfī-naẓarī interpretation and made ontological explanations about the creation of man by Almighty Allah. The author has tried to explain throughout his treatise that the curtains of the subtleties of creation will be opened according to the sulūk levels. With these aspects, bringing the work to the literature is important in terms of introducing the isharī interpretations made by a professional scholar about the place, person and objects in the verses related to the story of Dhu’l-Qarnayn in a manuscript. The sciences of kalam and fiqh, which have a special importance in the history of Islamic thought and science, became prominent with their interactions with other sciences in their formation processes and their contributions to the evolution of religious thought. In the literature, the field representing the linguistic, religious, mental and practical aspects of fiqh has become widespread with the concepts of usūl-i fiqh and fürū-i fiqh, and the part about creed as usūlü'd-dīn or fiqhu'l-akbar. It has drawn our attention (...) that Imam Abū Ḥanīfa and Imam Shāfiʿī's ijtihads, fatwas and thoughts have remained up to date in every century without exception in the vortex of overdoing and understatement in these two disciplines. However, there are some narrations stating that although these imams were interested in kalam, they kept a distance from it. Their, famous students also indicated that they gave them advice in this sense. Therefore, this study has been prepared in order to examine the background of the aforementioned issues. For this purpose, the reasons why two imams preferred the science of fiqh in the main axis of the subject were subjected to a general criticism. Consequently, it has been seen that both imams had similar concerns and their ideas have been overlapping in the face of the creed developments of the period. (shrink)

This study includes an analytical study of the term "Qiyās al-Adna” among the Scholars of Uṣūl al-Fiqh. It is known that the Qiyās is divided into the following types: an analogy of higher order (Qiyās al-Awla), an analogy of an equivalent order (Qiyās al-Musawi), an analogy of a lower order (Qiyās al-Adna). However, Qiyās al-Adna raised issues and objections among some scholars, in past and present; hence, there is an urgent need to present a comprehensive study that shows the meaning (...) of Qiyās al-Adna for those who advocate it, discusses the objections and issues that have been raised about it, and clarifies its connection to other Qiyās types. Moreover, the study will concern the applied side of Qiyās al-Adna by explaining how jurists used it. The researcher used the analytical method and referred to the most important, ancient and modern Uṣūl al-Fiqh sources and references. The study concluded with results, the most prominent of which is that the Qiyās al-Adna has two meaning: the first is that in which the original case is more deserving of legal ruling than the new or parallel case, so the new case is considered as a lower order, and the second is that the effective cause in the new case is weaker than in the original case. Among the results of the study is that the objections directed to the Qiyās al-Adna are weak, and that it is not limited to the presumptive Qiyās on the most correct opinion, also, that the jurists used the term Qiyās al-Adna in the second meaning, which says that the lower order is in its effective cause, not the legal ruling. It is possible to talk about many reasons that determine the direction of religious publications in the first quarter of the Republic, both in terms of content, style and method. While some of these factors came into play or became stronger with the Republic, an important part of it has a history that goes back to Ottoman modernization. The decline of the Ottoman state, which started on the battlefields, caused serious land losses. This regression damaged the self-confidence of Muslims and (...) spread the idea that salvation would be possible with a Western-style modernization. In this context, the obligatory relations with the Western world, which were established with the feeling of backwardness, were not limited to the military, political and cultural fields, but also spread to the religious field. For this reason, while Ottoman scholars and thinkers sought ways out through political and administrative reforms, they had to discuss the current understanding of religion and the religion-world conception formed in this direction. It has been especially emphasized that Islam does not prevent progress, encourages scientific and technical developments, and is compatible with the principles of reason and logic in terms of content. It is also known that the emphases in this manner maintain their vitality in the texts written both in the last period of the Ottoman Empire and in the Republic of Turkey. On the other hand, this approach, which was not possible to develop independently of the positivist and materialist understanding of science formed in a determinist framework of the West, also affected the field of creed along with the practical and moral issues of Islam. This situation continued and strengthened when it was transferred to the republican period. Because the founding cadres of the republic, who sought a secular and positivist ground, defended the idea that the religious field in general and the creed in particular should not conflict with the scientific understanding of the period. Expressed in the context of the present study, the political center thinks that there are compulsory fixed laws within the framework of cause-effect relationship in nature and that no effect is possible outside of these laws. In response to this attitude, the issue of miracles has been used in religious publications to express situations that go above the laws of nature, on the one hand, it has been tried to be discussed without prejudice to the attributes and actions of Allah. On the other hand, this discussion was conducted without giving the impression that Islam contradicts modern science. Discussing the issue under the influence of the secular and positivist framework drawn by the political center and Western intellectuals makes the issue a worthwhile subject to investigate. Because, in the period of the New Ilm-i Kalam, the restrictive attitude of the founding cadres accompanied the rational and scientific interpretations about the possibility of miracles. This situation significantly determined the content and style of the texts written during the period. In these circumstances, I believe that it is important to point out the points of conflict and reconciliation in the grounding of a religious issue such as a miracle. In this direction, while the current study covers the years 1924-1960 in terms of time, it is a study that especially includes the publications of the Presidency of Religious Affairs and Ankara University Faculty of Theology as a source. The date 1924, which was determined as the starting date, is important both for the establishment date in terms of the Presidency of Religious Affairs and for the abolition of the caliphate and the taking of some important decisions such as the Law on Unification of Education. On the other hand, the date of 1960 points to a coup date and some fractures in the political sense. During the study, I included the sources published by both the Presidency of Religious Affairs and the Faculty of Theology of Ankara University, as well as other sources directly related to these sources. The jurists, taking as reference the texts and the experiential studies of the period, preached various provisions regarding the issues such as fetal development, full birth or birth and death in this process. The majority made evaluations on the basis of the hadith about the fetal development process -mentioned in three separate periods of forty days-, but it was observed that this did not overlap with some medical guidance. Because the development period expressed by the jurists could not be prolonged, (...) it was determined that this process was completed before according to modern medicine. Jurists stated that he did not have any law regarding the fetus born before this period, since it was based on this period, and evaluated and evaluated whether those born later were alive or not. It has been presented in different jurisprudence in terms of various branches in fiqh, which is called “frequency” of the previous abortion effect after/during the full birth, and which is considered to be soul-blowing at the end of four months. These conflicts affected sons' abilities such as bathing, shrouding, burial and burial of the miscarriage. The mother also created many provisions such as her legal status such as nifas, talaq and ummu'l-veled, punishment lessons such as abortion and gurra, financial concepts such as heir and inheritance, and its effects on conditional contracts. In our study, in the event that the fetus dies due to the cell in the womb where the study medical information is located, the protections against it and the judgment it gives birth to in relation to it are discussed. Bu çalışma Aristo mantığının Arap gramerinin doğuşu üzerinde etkili olup olmadığı etrafında şekillenen tartışmaya ilişkin üç yazıyı ele almaktadır. Every word of the Qur'an ensures the understanding of the divine will. The foundation signs in it were created for this purpose. Just like the punctuation marks that ensure the correct understanding of a Turkish sentence, the foundation marks in the Qur'an have assumed the same function. The signs of foundation, which give the opportunity to breathe by interrupting the recitation at the places where the mana is completed, and the signs of ibtida, which provides the recitation starting from the (...) appropriate place for the integrity of the meaning, have a significant importance in the authentic interpretation of the Qur'an. The scholar, who wrote very important works related to the field and brought an independent topic under the name of "Secâvend" to the science of recitation, undoubtedly Muhammad b. Tayfur es-Secavendi. According to him, it is considered obligatory to dwell on the foundation denoted by the remzi (م) in the mushafs. Because when vasl is performed in these places, the nature and meaning of the verse changes. Based on these reasons, a foundation is different from other types of foundations. In this study, the signs of the need for foundation were examined within the framework of the verse integrity, and it was analyzed why Secavendi considered it necessary to make a foundation, taking into account the possible meanings that may occur in the case of vasl. There are some verses in the Qur'an that can be understood at first glance to mean that Allah Almighty knew certain things afterwards. Based on such verses, it has been claimed that Allah Almighty knew the voluntary acts of the slaves afterwards. This view, whose historical origin goes back to Cehmiyya, is defended by Abdülaziz Bayındır today. Adopting an approach that understands and explains the verses he refers to as the main reference on the subject, Abdülaziz Bayındır argues that the (...) thirty-first verse of the chapter of Muhammad and other verses with a similar notion indicate that Allah does not know beforehand the optional actions of His servants. In this study, the rational and narrative evidences that Bayındır presented as a justification for his views were examined within the framework of the basic procedural principles of the science of tafsir. In our study, the method of analysis and criticism has been adopted. While interpreting the verses that Bayındır examined as a basis for his thesis, the method he put forward was verified through different verses, and it was seen that this method did not offer an accurate and authentic methodology of understanding and interpretation. It has been seen that the verses that Bayındır put forward as a basis for his thesis do not indicate that Allah knows the voluntary actions of the servants afterwards, but that he reveals what he knows in his pre-eternal knowledge. In this study, the tahrîj method, which is used in answering contemporary Fiqh issues throughout the history of Fiqh, will be described and some sample fatwas given by the High Board of Religious Affairs based on this method will be analysed. Tahrîj is firstly to define the procedural and legal principles on which the singular views of a madhhab imam is based on, and then to determine the verdict of the issues in which an opinion from that imam is not (...) conveyed, according to the rules reached. Firstly the High Board of Religious Affairs will be introduced briefly highlighting issues such the effort put forward by the Board in the answering current fiqh issues, its contributions to the unity of fatwa and that it is a continuation of the Islamic Meşîhat-ı İslamiyye in the Ottoman Empire. Tahrîj, will be defined and its types, history, and its role in the development of fiqh and in solving current fiqh issues will be explained. Among the issues resolved by the High Board of Religious Affairs by applying the Tahrîj method or by making use of this method; commercial insurance, organ transplantation, gold-based lease certificate and the effect of injection/vaccine on fasting will be analysed. Given these exemplary fatwas, it will be tried to show that the method of Tahrîj is important today as it was in the past, both in terms of maintaining the consistency of fiqh and its contribution to the development of fiqh. The isnad and texts of the common narrations in the hadith literature of Ahl al-Sunnah and Shīa are an important source that provide information about the early periods of hadith history. The hadith, which is that subject of this article and whose text contains meaningful differences, “The essence of Islam is prayer, its branch zakat and its peak is jihad in the way of Allah” is a common narration with this characteristics. Because this hadith is narrated in Sunnī sources during (...) a conservartion between the Massenger of Allah and Muadh b. Jabal. On the other hand, in Shiite sources this hadith is reported during the conservation of Muhammad al-Bakir and Cafer as-Sadik with his companions. In order to determine how the change in the poles of the people who are the subject of the narration occured, firstly, information about the Shiite isnad and texts of the hadith was given, and it was determined whether the narrators were connected with the Ahl al-hadith circles. Then, the isnads and texts in the Sunni sources were pointed out, the connections of the narrators who transmitted them with Shiite circles and whether they adopted Shiite views or not were examined. Thus, it has been determined when, where and through which narrators the narration was transferred from one school to another, and also for what reasons the textual differences occured. (shrink)

In the 16th century Ottoman judicial system, there is a type of kadi which is mentioned as a land judge in both Rumelia and Anatolian provinces. The territorial judgeship, which is subject to different evaluations in terms of its nature, has been handled as a mobile kadi in charge of inspection by Ottoman historians since İsmail Hakkı Uzunçarşılı. Recently, some legal historians have put forward the idea that the land judge is a local judge. For this reason, first of all, (...) current discussions in the literature are discussed. It is focused on when and how the term land kadı was used in Ottoman records. Based on the documents, the different characteristics of these kadis were examined. Evaluation was made about the duties and responsibilities of the edicts sent from the center and it was determined how much this issue overlaps with the duty of the district/town kadis. It has been examined within the framework of archive records, fatwa books, kadi registries and the laws issued in the relevant periods over a period of about two centuries. As a result of the examinations made, it was concluded that the term land judge is not an independent kadi, but rather the kadi of the place where the events took place. (shrink)

Abu Bakr Razi, one of the important Islamic philosophers who produced thoughts on how to protect the physical and spiritual health of people, states that there is a close connection between the psychological well-being of people and their moral competence in his philosophical treatises on morality. In this article, Razi's moral thoughts on getting rid of sadness and healing spiritually are discussed in connection with the vital troubles of the modern individual. The main purpose of the article is to discuss (...) the possible contributions to the individual of approaching the problematics shaped by the dominant paradigm of the era in which the modern individual lives in line with Razi's thoughts on the improvement of morality. The importance of this study stems from the fact that Razi tries to analyze her spirituality-oriented philosophical thoughts in the context of the existential dilemmas of the modern individual who has strayed from the sacred, forgotten the purpose of existence, and identifies happiness with materiality. In the article, it is concluded that the moral thoughts of Razi, who put the Transcendent One at the center of her philosophy and act with the guidance of reason, are valuable philosophical thoughts that can guide today's modern individuals as well as her contemporaries. This study discusses the classifications of sects in a treatise named Firqa-ye Nājīye, written in Persian by a Shiite scholar in 982/1574. In this treatise, which is in the Merkez-i İḥyâʾi Heritage Library and has no other copy as far as we know, it has been tried to prove that the Twelver Shiʿa is the saved sect (firqa-yi nājiya) through seventy-three sects classification. The author summarized the seven doubts raised by the devil, the first events that caused the Muslim community (...) (umma) to disagree, and the general information about the sects from al-Milal wa-l-niḥal, the classifications of the sects from Sharḥ al-Mawāqif, but reconstructed the data in these texts according to the Shiite understanding. On the other hand, the main reason for writing this treatise is to respond to Jalāl al-Dīn Davānī’s claims rather than the classification of sects. Nasīr al-Dīn al-Ṭūsī determined a method for the identification of the saved sect as "differentiating from all sects in matters of theology". He claimed that the Twelver Shīʿīsm differed from the other sects in all matters of theology and was therefore the saved sect. Davānī stated that Twelver Shīʿīsm differed from other sects only with the belief in imamate, which is not the subject of creed, and that it generally agrees with Mu'tazila in other creeds, thus claiming that Tusi's claim is baseless. He also said that, when considered through the same method, Ashʿarīsm is more worthy of being the saved sect, because this sect differs from all sects in matters related to the creeds. Contrary to Davānī's claim, the author of Firqa-ye Nājīye stated that imamate was one of the most important principles of religion and also claimed that the Twelver Shīʿīsm differed from other sects in matters of creed other than imamate. The subject of this study is Poetry in Arabs: Cultural Characteristics and Financial Supporters of the Ancient Literary Genre. The problem of this study is to question whether poetry can be evaluated from a cultural point of view in Arabs and a cute lifestyle, aesthetic, symbolic and semantic dimension. In this article, not only Arabic poetry is evaluated in terms of culture; the cultural dynamics that enable the development of poetry are also emphasized. There have been great developments in social (...) studies in the modern period. New sciences such as sociology, anthropology, archeology and cultural history were formed. Among these sciences, sociology primarily focused on Western societies, while anthropology investigated non-Western societies. These sciences have studied human diversity in ancient societies and peoples. As a result of these studies, a lot of data has been collected about the cultures of existing and ancient societies; The history of humanity has been tried to be understood and its future has been tried to be predicted. However, the poetry of the Arabs, one of the ancient societies, is known by everyone, and while the Arabs are an advanced society in poetry, the cultural aspect of poetry has not been adequately evaluated. Recent studies in this field are a repetition of the past as a method. These studies are certainly important, but as in the past, Arabic poetry is discussed in the context of history, content, form, subject and poets with the beginning date of poetry and the fairs where poetry is performed are emphasized. However, it is time to consider Arabic poetry around the cultural corpus, which is considered important today, with the dynamics of culture and cultural perspective. Therefore, in this study, ancient Arabic poetry has been evaluated in terms of culture. The early period Ismaili jurist Al-Qādî al-Nu'mān appears as an important figure in the formation of Ismaili jurisprudence. There is very little information about Kadı Nu'mân's family, childhood, education and intellectual environment. His full name is Abû Hanîfah Nu'man b. Muhammad b. Mansûr al-Qādî at-Tamîmî Al Qayrawānî. He was born around 290/903 (late 3rd (9th) century) into an educated family in Qayravan in North Africa. There are different opinions about the sect he belonged to when he was growing up. On (...) the other hand, it is difficult to say for certain whether Nu’mān received education in the Ismaili sect due to the understanding of taqiyya in the madhhab. However, it is understood from the basic jurisprudence texts Nu’mān wrote that he most likely did not receive a Sunni education. Historians refer to him as 'Qadi Nu’mān or Abu Hanifah al-Shi'i' in order not to confuse him with the imam of the Hanafi school. Qādî Nu’mān served at different levels of the Fatimid State. Around 313/925, he entered the service of the first Fatimid caliph, Mahdi (r. 909-934 CE/297-322 AH), as a copyist and secretary. During the reigns of the third caliph Mansur and the fourth Fatimid caliph Mu’izz (d. 365/975), Qādî Nu’mān first served as a judge in Tripoli and then in Mansouriya, the Fatimid capital. After the Fatimids conquered Egypt and the center of government was moved to Cairo, Qādî Nu’mān was appointed by the fourth caliph Mu’izz as the head of the appellate courts (maẓālim). Qadi Numans career was at the peak in the period of Caliph Muiz. Qādî Nu’mān worked as a judge in the Fatimid State for about twenty-six years and continued this duty until his death in 363 (973). After the fall of the Fatimid caliphate, there haven’t been any other Fatimid or Ismaili jurists. Qādî Nu’mān is considered by contemporary Ismaili writers as a figure who systematically transformed Ismaili fiqh into an independent sect of fiqh. It can be said that Ismaili fiqh was developed through his works in the Fatimid period. His works continued as the main references in the fiqh studies and after the Fatimid period. With the death of Qādî Nu’mān, the period of ijtihad in Ismaili fiqh and its the establishment phase of Ismaili fiqh came to an end; The sect, in which esoteric interpretations were at the forefront, emerged as a distinctive school of fiqh by discarding ambiguity. Qādî Nu’mān was a very productive writer. He wrote important works related to the field of furu al-fiqh and usûl al-fiqh. Among his works, Ikhtilāf uṣūl al-madhāhib is undoubtedly one of the most important works in the early history of fiqh methodology. The work in question, which was originally written with the aim of rejecting the Sunni fiqh method, discusses the approaches of the Sunni schools of fiqh on ikhtilāf, taqlid, ijma, nazar, qiyas, istihsan, ijtihad and ra’y in a polemical manner. It reveals the differences of the Ismaili method from the Sunni method in terms of the sources on which the fiqh is based, the authority to make ijtihad and the theory of interpretation of the texts. Qādî Nu’mān examined the relationship between reason and revelation in general and the role of religious authority in comprehending and interpreting the texts while criticizing Sunni methods. Ikhtilāf uṣūl al-madhāhib has the characteristics of the works of development period as a form. It is possible to observe the question-answer and dialectic form which can be seen in the works of the development period throughout the work in question. Qādî Nu’mān endeavoured to persuade his opponents with a dialectical and argumentative style. Again, he replied to the Sunnis, who were his interlocutors, with their own proofs. In addition to these, Ikhtilāf uṣūl al-madhāhib has a unique feature in the matter of content. Because it is not very familiar to any Sunni handbook of usûl al-fiqh. It does not mention the hâss, âmm, ijma, qiyas, amir, nahy, alfaz bets, etc. The text is very similar to the Ahbari movement of the Jafari sect for it rejects all forms of ijtihad. It was written at a time when fiqh was not yet stable. Ikhtilāf uṣūl al-madhāhib gives us crucial information about the development of different usûl and fiqh sources in the middle of the fourth century. However, what is interesting here is that the information he gives about Ismaili method and fiqh is very little compared to the one about Sunni method and fiqh. When the Qur’ān was revealed, it primarily used the language of the first addressees, Arabic, in the most impressive and understandable way to convey its message. In doing so, it used all the possibilities allowed by the range of meanings and rules of the language. While the Qur’ān conveys its message to its addressees, it sometimes uses long expressions, sometimes quite concise ones, and even a word or preposition in some places. Due to the structure of the language, the words, (...) the smallest component of the language, and, peculiar to it, even the prepositions and letters, due to the morphological structure of Arabic, are the elements that completely affect the meaning. Like many other letters and prepositions in Arabic, the preposition “إنْ” handled in this study undoubtedly has an important effect on the meaning. We generally encounter, in many verses of the Qur’ān, the use of this preposition in the sense of condition, which is the most basic meaning in the language. In addition to this meaning, the negative, emphasis, and causal meanings are also the other uses of this preposition according to the integrity of Qur’ān and the context of the verses. Apart from the meaning of condition as the basic meaning of the preposition “إنْ” in the Qur’ān, whether the meaning of cause/ta‘līl exists in the language and this meaning is used in the Qur’ān is basically an issue discussed by the Basra and Kūfa language schools, the issue has still been discussed by the exegetes as well due to its effects on the meaning. It is quite important for correctly understanding the Qur’ān to determine the effect of the preposition “إنْ” on the meaning when it is mentioned in the Qur’ān and to give the appropriate meaning to the context. This paper is also important in that it aims to deal with the effect of the preposition in question on the meaning in the verses where there are controversial approaches and in the example of the use of the verb form “إِنْ كُنْتُمْ". In the study, the approaches of the exegetes to the verses on which there are problematic approaches are transferred from the major interpretations written from the early period to the modern period and some evaluations are included with an analytical view. Although the Basra language school and some exegetes following them say that “إنْ”does not mean causation, the linguists of Kūfa and the exegetes following the same line have stated that it also means that, and they showed examples from the āyāt (verses) and hadiths that it is not correct to use this preposition in the meaning of condition in some contexts in the Qur’ān. For example, they argued that the use of the expression “إِنْ كُنْتُمْ”used about angels in a verse in Sūrat al-Baqara 2/31, as “if you are of the truthful” would raise doubts as to whether they were truthful or not and this would contradict their qualifications as angels. On the other hand, they argued that giving a conditional meaning to “إِنْ كُنْتُمْ”at the end of the verses starting as “if you are believers” or the ones in which the believers is directly addressed as in al-Baqara, 2/278 and Āl ‘Imrān 3/139, would cause a contradiction between the beginning and the end of the verse, and that this style would cause a problem on the ground of belief about Allah. In the same way, some linguists argue that giving the meaning of conditions to some verses poses a problem in terms of the context and the style of the Qur’ān, and they explain this situation through al-Baqara 2/23 and similar verses. For, although it is certain that the polytheists doubted about the Qur’ān in the verse in question according to them, the statement “If you are in doubt about the Qur’ān, bring a sūra (chapter) like it” fits neither context nor fact. The Basra language school who constitutes the majority and think that the expression “إِنْ كُنْتُمْ”mostly found at the end of the verses in the Qur’ān includes the meaning of condition, and the other exegetes following them have systematically added the meaning of condition to all of the verses in which the aforementioned preposition is used, and in cases where the meaning of condition is problematic or subject to some objections in terms of context, they have resorted to various linguistic explanations such as omission (hazf), precedence-postponement (taqdīm-ta’khīr) and metaphor. As far as it can be determined in this study, except for some scholars of wujūh and naẓā’ir, there was no one who constantly gave the meaning of cause in the verses where the meaning of condition is open to discussion, whereas some exegetes gave the meaning of condition or cause/ta‘līl depending on the context and used all the possibilities of the language by acting more freely. However, it has not gone unnoticed that they present a problematic interpretation style by displaying different approaches in similar āyāt (verses) that come in the same context. (shrink)

In order to determine the authenticity of the hadiths, some conditions were determined by the hadiths regarding the proof and text of the hadith. There are aspects of these terms regarding the deed and the text. One of these conditions is that the hadith is not illegitimate. There are some types and reasons for the disease known as a hidden defect that harms the health of the hadith, and there are some methods used by the hadiths to detect the disease. (...) It is possible to divide these methods into two main headings. One of them is the method of reaching the cause of the hadith by making cem-i turk, and the other is the ability of the hadiths to reach the disease of the hadith with the skills they have acquired due to their preoccupation with hadiths. The cem-i turuk method, which is used in the detection of malady, concerns a wider area of use, while the detection of malady with the faculty of hadith concerns a more specific and relatively narrow field in scope. One of the methods used by hadith scholars in determining malady is the criticism that "it does not resemble the narration of so-and-so". This method of taqīd is a method applied by the hadith faculties of hadith. There are many studies and theories in the literature on the source of power in the formative years of the Mamlūk state. In these studies, the importance of power and influence as a form of becoming a sultan in the Mamlūks has been emphasized, although the oligarchic power of the umara has been indirectly mentioned in terms of the source of power by discussing the distinction between a puppet sultan and an authoritarian sultan. However, this axiom causes a number of (...) problems and ambiguities within itself and leads to the supersession of the determinism of the elite amirs. This work will try to overcome this problem by focusing on the political developments during the foundation years of the state and discussing how powerful and influential amirs were restricted by the umara on their way to becoming sultans. At the same time, by focusing on the chronicles of the period in question, the administrative determinism of the Mamlūk factions as a decision-making mechanism in the Mamlūk state will be pointed out. On the other hand, the statement that power emanated from both the sultan’s household faction and the military support of the elite amirs or khushdāshs who held the Mamlūk oligarchy in their hands leads to overlooking the tension or conflict between the two throughout Mamlūk political history. Considering the state of conflict between the two sides, it is a logical contradiction for the two opposing poles to agree on the same candidate. For instance, considering Muʿizz Aybak’s accession to power, the Sālihiyya-Bahriyya amirs unanimously endorsed his sultanate, but in the process, Muʿizz Aybak prevailed over the tensions he experienced with the elite that brought him to power and managed to become the absolute sultan, albeit for a short time. Therefore, it is essential to keep in mind that there was no uniform relationship between the sultan and the elite amirs, but rather a dynamic functioning. In other words, the future sultan, who had to establish good relations with the amirs until he became sultan, had to go against the amirs who brought him to power if he wanted to become an absolute ruler after he became sultan. In this study, the source of Mamlūk power is traced to the collective interests of the Mamlūk factions. It is emphasized that these interests were usually centered on candidates who were seen as more moderate among the factions. At the same time, by revealing the shortcomings of the understandings presented as a rule such as “the one who kills the sultan becomes the sultan” and “the powerful and influential become the sultan”, the analysis of the period from the founding years of the Mamlūks to Baybars’ sultanate mostly emphasizes the continuity of the status quo of the elite amirs by highlighting the “sultanate of weak and middle-ranking amirs”. The analysis has pointed out that those who killed sultans or usurped the throne were punished rather than usurping the throne as a legitimate right. Similarly, the consensus of the umara on the candidate for sultanate was pointed out by mentioning that those who were powerful and influential were being challenged rather than made sultan. Today as it was in the past, faith in shafaat is accepted by some groups while it is rejected by some others and both sides base their views on the Qur’an. When we examine the Qur'an, we see that some of the verses related to the theme refer to the existence of shafaat and the other part of it speaks the absence of shafaat. The Qur'an is a divine book which superstitious cannot get close to it in anyway. One of (...) the most important characteristics of the Qur’an is that there are no contradictory information and provisions that lie against each other. However, the Qur’an was taken as a reference for both denial and proscription of shafaat. Both the approval and rejection of the Qur'an the same intercession is a paradoxical situation incompatible with the divine word. This leads us to determine two different types of shafaat accepted and rejected according to the Qur'an and the differences between them; therefore, this leads us also to examine the related verses holistically. In this respect, we will try in this article to examine the verses about the possibility and impossibility of shafaat in the Qur’anic integrity. In the same way, we will try to determine the nature of the shafaat that the Qur’an rejects and approves of. (shrink)

The principles offered by beliefs affect the thinking styles of individuals. Although it has been argued in recent studies that believers and non-believers have different thinking styles, there are few studies examining the relationship between belief and cognitive styles in Muslim groups. In this study, the relationships between intrinsic religious motivation and "critical thinking", which is one of the most desired thinking skills today, and " dichotomous thinking", which can be expressed as black-and-white thinking and primarily associated with negative structures, (...) were examined. The study was carried out with 395 university students, and the data was obtained by a socio-demographic information form, the Intrinsic Religious Motivation Scale, the Critical Thinking Disposition Scale, and the Dichotomous Thinking Scale. Findings suggested a positive significant relationship between intrinsic religious motivation and critical thinking and dichotomous thinking, and a positive significant relationship between critical thinking and dichotomous thinking. Regarding the relationship between dichotomous thinking and critical thinking, intrinsic religious motivation had a mediating role. The Islamic faith often invites reasoning and thinking and affirms this way of thinking; at the same time, it offers various conceptual tools for dichotomous thinking with discourses such as heaven-hell, good-evil, dark-light, and faith-denial. Although critical thinking and dichotomous thinking are seen as opposite constructs, the findings have been interpreted as the Islamic belief supporting both critical thinking and dichotomous thinking at the same time, thus reducing the rigidity of dichotomous thinking. The findings were discussed in the light of the relevant literature, and suggestions were made for further research. (shrink)

Sezai Karakoç, who is a one of the most important poets and thinkers of the last period, developed an ideal by adapting the concept of resurrection in the creed to the resurrection in the world. His ideal of Seeing it as reviving the Sunnah of the Prophet Muhammad, Karakoç defined his cause as his cause. Prophet Muhammad, who has no direct relation to the knowledge of Hadith, but to the center of the world of thought. Karakoç, who put the Prophet (...) as a “measure” and “principle” or “blessed word” in some of his works, has made quotations that we can collect under headings such as the search for truth, the importance of knowledge, good morals, the battle with the soul, preparation for death and zuhd, without referring to anyone. The extent to which such transfers of uncertain affiliation take place in the hadith sources or to what extent they are related to hadiths has aroused our curiosity. We aimed to determine the place in hadith sources and their value in terms of hadith science, which Karakoç accepted as a "holy word" or as a rule and mentioned them in quotation marks without attributing them to anyone.
